His spending habits would suggest that he has more than enough to pay everyone back, but he would be at loss for what he wants, not needs... This way he can argue that he never intended to scam anyone, he just found himself in a bad spot and is trying to make good. This could raise reasonable doubt as to his intentions which would have to be proven in order to get a criminal conviction.
