From day one, I knew the repairs were far more extensive than their visual estimate. They initially assumed 10k in repairs. I told the adjuster about the E46 convertible's unique structure, how the sensitive and expensive a-pillar piece could have been compromised, etc.
Well, he continued to tell me that it wasn't that bad. Yeah, right.
While my back, neck, and leg continued to suffer, and as I continued to seek treatment, the repair costs continued to increase in about this order:

On top of that, BMW sent a random inspector from Germany who checked on the work and decided the work on my car wasn't up to spec, requiring the body shop to go in and make more adjustments, raising the repair costs even further.
+Repairs: $17500+Buyback: $21500+Medical: $10000 (and rising)-Auction: $8500+Rental: $3200----------------------------------------=Total cost to Safeco: $43700.
I contacted my state senator asking about Missouri's laws and what it took to total a car here. His office called me back within 24 hours, answered my questions, and had someone at the state insurance commission call me to help out. Then the senator's office called back to make sure I was given a satisfactory solution.
The lady at the commission suggested filing a formal complaint against Safeco Insurance, so that was done. She also agreed that the car was worth a bit over $20k, not $23k -- "How could a car be worth more than what you paid at a dealer for it?"
They had 20 days to respond to the complaint with a solution or explanation, and now we're coming on day 19. Safeco, being unable to defend their valuation of the car, had to total it despite having spent $17k on repairs, which they could have avoided if they just listened to me and weren't so darn stubborn.
I was at a point where I was screaming at the top of my lungs on the phone to everyone I could, from the rental administrator to the adjuster; now I can finally relax. I may need knee surgery now, but the rest of the drama is over.
BMW builds one hell of a solid car, and their repair standards are very, very high.
