Well so far, looks like VA is one of those states with some Nazi-leaning politicians with nothing better to do than to pick on hobbyists:
Virginia Exhaust Noise: SAN (SEMA Action Network) model legislation that would allow vehicle hobbyists to install and use aftermarket modified exhaust systems that meet a 95-decibel limit under a fair and predictable test standard was not approved in Virginia. The bill sought to remove subjective provisions in the law and force compliance with an objectively measured standard. Under the standard, exhaust noise could not exceed a sound reading of 95-decibels under SAE test standard J1169. The measure was introduced, at SEMA’s request, as a remedy to the enforcement policy currently used by police officers in which nearly all exhaust systems not of a type installed as standard factory equipment are considered illegal - even where noise levels are not excessive or unusual. This policy leaves enthusiasts, exhaust system manufacturers and dealers without recourse. The bill will be introduced again in 2006.

I would recomend beginning to document your defense ASAP. Contact Nissan and find out what a replacement exhaust costs for your car. See if there is a way you can take sound readings from 20 feet behind your car, at a 45-degree angle, at 3/4 throttle (most states use this method).
Document everything and present it to the judge. Your defense is this: It is UNREALISTIC for the Courts to require individuals with older cars to spend more than the car is worth to install an OEM exhaust system when there are others on the market that are not only less expensive, but MAY WELL BE quieter than OEM.
