street racing + driving to endanger

was driving today (rain) and having some car follow me. speed limit was like 30, i was going 50; couldnt stop, smashed into a wall (at a turn) ..all these parents *****ing we were "racing". cop court summoned us for "drag racing" and "operating to endanger" ..i live in massachusetts; whats the worst that could happen & for how long? p.s. the 240sx is in critical condition.

§ 17B. Drag racing; penalties

No person shall operate a motor vehicle, nor shall any owner of such vehicle permit it to be operated, in a manner where the owner or operator accelerates at a high rate of speed in competition with another operator, whether or not there is an agreement to race, causing increased noise from skidding tires and amplified noise from racing engines. Whoever violates the provisions of this section shall be punished by a fine of not less than one hundred nor more than five hundred dollars and the registrar shall suspend such operator's license for a period of not less than thirty days. A subsequent violation shall be punished by a fine of not less than two hundred nor more than one thousand dollars and a suspension of such license for a period of not less than sixty days.

This is the MA statute on drag racing, I can't find the operating to endanger in any context other than commercial licenses; but get me a statute number and I'll find it for you.

skyrocket isn't a word I would have chosen (isn't strong enough), increasing by elevendymillion times what you are paying now is more like it.

Most likely they will just totally drop your coverage, no matter how much you are willing to pay.

Again, if you get me the number of the statute from the ticket, I should be able to find you the penalties. It seems this is a form a negliegent driving as opposed to reckless - so the penalty should be less, though it still may be a felony. Good luck with that one. Seems a fair assessment, you definitely were driving negligently, though I guess they could have just given you driving at speeds unsafe for road conditions.

I think the consensus would be to fight it with a lawyer, your chance of getting the most serious charges dropped are very good, no matter how much conjecture by standers were expereincing.I have had tickets nixed before w/ no prob (including one drag racing)Remember:Nobody races in the rain, everyone knows that, even a judge.

Fight this, it's B.S. and you stand to lose a lot if it goes down like this. I'm no Lawyer but were I in this situation I would cop to "speed too fast for conditions" and accept the fine for that, it's justified and they really have no way to prove you were racing even if you were.

Generally there needs to be a history (read: more than one incident) of bad driving before an insurance carrier will drop you. State Farm kept me around until I racked up 7 points in a little over a year and a half.

I could be wrong though. There may be some provisions if it's proven that you were driving like a moron... which you were. Twenty over in the rain? Give me a ****ing break man!

I love it when people get all judgemental like they never do anything stupid in their cars and start ragging on people.:rolleyes I like racing in the rain, it takes more skill to push a car on the edge of adhesion. By no means do I endorse it and I acknowledge it is dumb as it comes but I sometimes do it.

I agree with scientist on both his points he made on both his posts. On the second post, i totally agree!! rain ups the ante, so to speak... and it is stupid at the same time. I know this coz i'm dumb enough to admit i've done it alot, and i'm also aware of the dangers of serious injury/death involved. riding a bike in the rain at high speeds takes this all a step further, especially in dangerous traffic situations. Being reckless will catch up with us all sooner or later. Use caution.

lmao, I was just doing 100 in the rain just today, I even car weaved 2 or 3 times. However, I'm a goddamn good driver. I also know the limits of my car and tires in the rain. 20 over is chump change.

The only thing I wonder is how the hell you wrecked goin 20 over...cause if you didn't know the road, then maybe you shouldn't have been goin that fast.

But either way, do as Fred suggested, get a lawyer....

It doesn't matter how good you are, if somebody does some **** unexpectedly and you're flying in the rain, you're ****ed.

My friend was only going 4 over in the rain, switched lanes to go around someone, and hit a pile of leaves that came outta nowhere, did a 360 and slammed into a pole.

(speed wasn't really a factor but still, its just worse if you're going fast)

Yes, Nismoflip, they sure do. The "anyone" you refer to are the useless bags of flesh who cut us off, or do ten under while in the passing lane, or have never looked before turning, hit the brakes for no good reason, talk on the cell phone while stuffing a burger in their face and so on. They do give em to anyone, and we are all in great danger because of it. BTW, if "driving fast" in the rain were so bad, they'd have to outlaw freeways huh? smart fella...

If you dont know the difference between a FREEWAY and roads with lots of sharp turns, stoplights, people, and buildings....use ur head.

This guy that crashed doing 50 in a 30 in bad conditions deserves to get whatever charges hes guilty of for that, however if the street racing charge is bogus then he should fight it. If you drive recklessly you must accept responsibility for your actions. Say what you want fella's, blame anyone. I don't care....Most of the people on this site drive over the speed limit, anything can happen at anytime, rain, dry, doesn't matter. Your never in control...its just an illusion. I drive the way i do cause i want to. The 100mph was on the freeway, not a friggin side road. I was just using the excessive mph cause i don't understand how you wreck goin 20 over....

Fight it, tell them how fast your car is and if you were 'racing' you would have been going much faster than 50mph. :) 20 over in the rain isnt that big of a deal guys. I've hit my governor in the rain. Do what you want, just don't danger others. I was on a back road.

ya, esp in a 30. nmaybe if it were a light sprinkle on a freeway thats striaght with no triffic and you had nice z-rated tires. i could see 70. but no not in a 30. jeesus
