I ordered a set of s15 silvia headlights from him back over two and a half months ago.

To date, they have not arrived, I have called this guy a few times a week and emailed him aswell.

I gave him all the time in the world for the lights to show up, and finally we decided he would simply refund me.

Twice now, he has sent me a refund via paypal and then cancelled it before it clears.

I would just like to advise anyone consdiering buying from him in the future that you may have to deal with a situation like this.

Mods, please do not delete this as it is a serious issue. I have lost $600 cdn dollars as a reuslt of this person.

I have told him repeated times that i'm going to inform other members on the site and he does not seem phased by it.

if mods would be intrested, i have kept about 90% of his emails he has sent me, and have his contact info courtesy of ebay.

im sure andre will add to this thread, and i urge this so we can have this issue resolved immediately. Its been far too long now.

he also told me via phone that he had a second set of these to ship to me if mine dont show up.

i asked him about the second set a few days ago and he told me he sold those ones to someone else. (also have emails about this)

can do, one more thing i forgot to mention

i called the place he calims to have shipped them from and they told me that they have no record of him and that his story about how they didnt give him a tracking number was sketchy

the supervisor at the postal annex where he said he shipped from advised me that she also feels im being scammed. i have her name and info aswell

march 2 - (after me telling him im filing a paypal claim, which they didnt help with at all.)go right ahead. your going to feel stupid when you receive them in the mail. what an ***. seriously. Hey I guess I can take legal matters after you receive them.

march 3 - ok I understand. this has happened to me before. they file a dispute receive the item and then well you know im fu#$ed . Thats what made me mad. and if you dont receive them for any reason your money will be returned. so please dont worry. Ive been selling parts locally for a long time. so I dont think well have anymore problems. thanks.

March 15 - sorry I just found another company. item will be sent out tonight sorry for inconvenience. (regarding him finding a shipping company for my lights after he told me he could not find anyone)

march 19 - no what you know I know. like you said Im going to give a week and Im goint to go and complain to postal annex. and ask them what going on. thanks.

How would I scam you ? be patient. I ve responded since day one so theres is no reason for you to be acussing me of scaming you. I also lost my headlights and now I am giving you back the money. so I dont see how you say I am scaming you? that is what seriously upsets me. another thing who is going to replace my headlights? no one. I have agreed to refund your money.

april 18 - I sold the other headlights, as I thought you would receive yours. and yes work and school is crazzy I work as a club promotor and cingular tech support. so yeah I am very very bussy. and well I get off work at 11:00 pm

I can also provide proof to the two cancelations of my refund via paypal.he claims he doesnt know why they were cancelled.

I spoke with a paypal rep the first time this happened and she informed me that the cancelation can only be done on his part either manually or by not having the funds in his account. This is why we went to the payment plan as oopsed to lump sum.

However, it still cancelled 1 hour before the schedualed clearing time.

I cant beleive you are calling me a scammer. I have been in contact with you constantly. I have the money in my bank I talked to you when I was making a deposit on my bank. I have no ****en clue why they keep on canceling. I have never said that I would not give you your refund. I mean I have told you a million times I have given you all my info my address and everything why would I try and scam you? you basically can have me by the balls, I am not stupid and also not a thief. I earn my money just like everyone else I work for everything I have and I dont lower myself to steal from other honest people. and like you said we have to find a different way on sending the refund. may be moneygram or something.

Im aware that i have your contact info but being in canada, i have no way of really enforcing any refund.

as i stated in my last email to you 9sent now more then 20 minutes ago), we can try another method of refund outside of paypal. ( money order, cheque, ect)

i have been informing you this thread was coming several times for about 2 weeks now and you had no reply and did not seem fazed by it.

as AZHitman said, he can delete the thread when this is resolved.

I have no hard feelings, I would just like to get my money back.

I think money gram is the safest. If you know of a better one or something that you know tell. me. I will email you right know. on more info on money gram.

I know neither of these parties (niether personally nor via NICO). But sounds like a solution has been reached.

i did a search but came up short.

i new to nico, but have been a regular on son240sx.ca (local canada forum) for years. dont know many people on nico.

I don't think there's any excuse for a refund to take two months. Doesn't matter how busy you are. I myself have two jobs and work 7 days a week and ALL of my bills get PAID on time. Hope you get your money back mat180.

Don't worry Matt, Hitman and the mods will take care of you. I know they helped me out a great deal when I almost got ripped off. As a matter of fact, I consider the other guy involved in my situation to be a pretty cool guy now. (I'd never try to buy anything else from him, but I think he's a pretty cool guy...)

Good luck. Oh, and Andre, I don't think they have MoneyGram in Canada. You'll probably have to go with Western Union. Do the right thing.

It's becuase you're manually cancelling them or you don't have the money punk. What didn't you understand about him actually phoning paypal and getting the real answer.

The way I see it is, if you sold another pair of S15 headlights to someone there's your money to refund him right there. You stated:

After a month and a half (based on the e-mail dates provided) you thought his would still magically appear in the mail? You should have used that money (if indeed you had it) to refund him his. Sounds like you're just trying to yourself out of this little scam you've made. Hey, maybe it's a legitimate mistake or lost item, but you've got to understand how it looks to the buyer and us. If it looks like a scam and smells like a scam, it probably is a scam.

This Andre guy sounds sketchy. Too many excuses constantly spewing out. According to him, it is everyone elses fault but his own.

Mat, I ended up selling the 300zx rear calipers to a SON member in Hamilton. The coils are holding up great so far, even with the crappy roads in scarborough. I never did end up posting pictures on SON, but here is a link on Nico in case you were wondering how the stance of the car ended up looking.
