Ripped off by a NICO Moderator...story inside for those who dont know.

So as some of you know, I have a 91' 240sx in my garage on jackstands without a motor because the previous owner blew it. I bought Nomore_MR2 (Brian Baker's) motor from him as advertised in this: http://www.nissaninfiniticlub....18999 thread. I then proceeded to place an order for: HKS GT2540 turbo, HKS front mount intercooler, stock exhaust manifold, tomei 1.6mm headgasket, apexi power fc with commander and boost control solenoid, stock power steering pump, custom fuel rail with 75lb. hr. injectors, and an engine wiring harness with ECU. He assured me that he could get me all of this AT COST for him and that ended up being 2400 dollars on top of the 1700 for the engine, which meant I paypalled him 4100 dollars thinking that within two months my car would be totally ready to go. Well, we settled upon a date of May 15th for everything to arrive and up until then he was very communicative and the engine arrived when he said it would. However, none of the other parts arrived (except for coil packs and cams from boost_boy >>>who's a trustworthy guy I might ad) when the parts didnt arrive on the 15th he told me it was because he miswrote the address and he would correct the problem and send the stuff back to me airborne express. After this I had very little communication with him except an occasional "yeah, I'm shipping them out soon, I'll e-mail you the tracking numbers." In which he stated the parts would be here by the end of this week, well it's friday night and they are not here, leaving me with only one conclusion to draw...he's been drawing this out and lying to me all along, he has never had the parts in his possession at all and is unable to deliver. He also will not return my calls or e-mails, apparently he is "very busy." Very busy is NOT a good excuse when you have stolen 2400 dollars from someone. In response towards his apathy for the situation I have contested the charges with my credit card company (I'm going to have to ship the motor back) I've filed a complaint with paypal, I'm calling his chamber of commerce and police on monday to see about filing charges. I might contact all the people he has ripped off before about this as well and see about getting a lawsuit going or at least a lot of charges filed against him. This was my hard earned money and I will be damned if he is going to take it from me. Does anyone else have any suggestions about ways to get reparation from him? Thanks for listening guys, and most importantly: dont ever do business with Brian Baker. I will follow him all over the internet if I have too, but everybody will know what a piece of stealing trash he is.

Yeah, I have his address...but beating him will only get me in trouble. I just want my damn money back or my parts...one or the either.

ONE reply...it was the one saying everything would be here this week (which obviously it wasnt) He keeps giving me empty promises, false tracking numbers, and nothing but excuses. If he rectifies the situation, I'll ask a moderator to delete this thread as well as any posts in other threads I have made that were derogatory about him. Until that time though, I have no choice but to believe he has ripped me off just like the others.

Thanks YamaOni...I've given him lots of slack allready, I've left countless phone messages and e-mails telling him to get me the tracking numbers or I'd have to pursue ways of getting my money back and he's never shown the least bit of care and the one time he gave me tracking numbers they didnt work...and of course he had an excuse for that too.

I'm incredibly sorry about your current situation. Doing business online with private parties is not nearly close to safe yet, unless mediated by a 3rd party (a la eBay). I wish you the very best luck getting your money back, and hopefully getting some charges filed so Mr. Baker will suffer the consequences. Don't let it get you down! You had a mighty impressive project that you would have had completed without Mr. Baker's interference. Its very impressive. Get your money back, order the kit from someone more trustworthy, and lets see another sweet, boosted 240 on the roads.

Ahhh, but therein lies the problem...I dont have nearly enough money to afford that stuff at normal prices, I payed what was supposedly "his cost." But dont worry, it'll be boosted at some point, just perhaps not as much as originally anticipated :( I'm calling around looking for a motor tomorrow, we'll see how it goes. I have to send this one back in order to meet the requirements of my credit card company to get my money back. I think I'm going to do it too, I'll be out 800 dollars but get back 3700...I think I can get a swap done for that much, but it'll be hard :'( So much for my new job, I know where the money is going now...forget paying myself back for this damn motor, I'll be sinking even more into the project.

That's why you keep your stock KA :) Seriously though man, that sucks, having a 240 but not being able to drive it is one of the worst feelings. Keep pushing him and get back anything you can get. Be greedy :)

yea I'd really like to say cut the guy some slack, cause maybe he really DOES have some personal problems or whatever going on.. but the lack of contact and even fake tracking numbers (?? wtf??) is waaaaay too much. If you think he is ignoring your phone calls, then call from a different phone (even one with a different area code if possible) so that he doesnt recgonise it on the caller ID... make it clear to this guy that you are serious and give him a specific date that you will call your lawyer on.... I'm pretty sure you'll be okay.. you have plenty of evidence of what happened- it might just turn out to be a pain in the a$$ for you at the worst. Good job posting it here, fair warning for him and for the rest of us in the future.

Fiznat...I placed the order and payed in full on April 15th, we then agreed on one month (May 15th) as the final date for everything to be here. Well, he said he had shipped some things and they would be here May 9th but it didnt happen, I contacted him and he said that they had sent it back because of the wrong address...from then on it just went downhill with him being more and more unresponsive. It has now been over 3 weeks since everything was supposed to be here. And Touchdown...I cant keep my stock KA, it has a hole 2x8 inches where cylinder #1 used to be (the previous owner blew the engine :))

lol......i took care of that stock KA Touchdown038. He doesn't have that option....when I sold him that S13 there was a 2x3" hole in the side of the block. I'm rootin' for ya Nathan!

Niiiiiiiiice job on putting a whole that size into the block. That takes talent :)

Oh, and I hear that KA swaps are pretty cheap and easy to do - let me know if you're interested. I got one sitting in my friend's garage that can be had for very cheaply... hell when you can have that, why would you even think about the CA? :)

man, this thread got ALOT of responses in a day! anyway, i too am owed by brian. i ordered an hks manifold from him about 3 months ago. $325 was the price. if you do anything nathan, please let me know. i really need the money. (i know its not 4 grand, but its enough to piss me off!)

nathan why do you have to send teh motor back to contest the charges on the rest of the merchandise? you paid for the motor you got the motor should be able to keep it, once again guys get hold of me !

I'm not trying to be an *** here but i do recall someone from a certain MR2 board registering on these boards and warning us about how Brian had ripped several of them off. I seem to remember everyone blowing him off and telling him that everything would be fine. The funny thing is that my searches for this post have turned up empty. I hope someone didn't delete this post and some of you guys didn't get a chance to see it earlier on. Either way, i know how hard extra money like that is to come by and if there is anything i can help with i'll be around to support you until you get action taken and your money returned.

Yep, I talked to Brian about those posts, he had a good excuse and I think he moderated them right out of existence. At that time I had nothing to worry about, the motor had arrived right on time and he was talking to me regularly. Rtsol...I figured I'd get more response in the 240 general section ;)
