window tint violation

Hello, I've been here a while reading posts but never signed up. I have an 08 versa, got it about 5 months ago. Any ways this weekend i was driving and got pulled over for my speed. He said, "watch your speed we have a lot of accidents around here." Then he started asking me about my tint. I told him i got it done when i got the car. I gave him all my stuff he went back to his car did what they do back there. About 15 min later he came said i was going to get a window tint violation instead of a speeding ticket. This happed all around 10pm all he did was look at my windows with a flashlight. Last night i did a little research and found out that most cop cars have something to test the amount of light that passes through a window to test the tint. So, I'm thinking how the hell does this guy now what my tint is with out even testing it!!? to make it better how can i get a ticket when he didn't test it. to me thats like giving someone a dui with out a breathalyser. What do i do? Any one been through this before?

Get a statement from the place that did the tint as to what the tint is. If it's within legal parameters, take the statement with you to your court date and have them dismiss it with prejudice.

California Tint Law Enacted: 1999

HOW DARK CAN WINDOW TINT BE IN CALIFORNIA?

Darkness of tint is measured by Visible Light Transmission percentage (VLT%). In California, this percentage refers to percentage of visible light allowed in through the combination of film and the window. Windshield Non-reflective tint is allowed on the top 4 inches of the windshield. Front Side Windows Must allow more than 70% of light in. Back Side Windows Any darkness can be used. Rear Window Any darkness can be used. HOW REFLECTIVE CAN THE TINT BE IN CALIFORNIA?

Similar to sunglass lenses, some tinting film contain metallic elements that help in reflecting incoming light and reducing the glare and heat generated by visible light. Front Side Windows Must not be more reflective than a standard window. Back Side Windows Must not be more reflective than a standard window. OTHER CALIFORNIA RULES AND REGULATIONS

Restricted Colors The tint color(s) of RED are not legal by state law. Side Mirrors Dual side mirrors are required if back window is tinted. Certificate Requirements Manufacturers of film do NOT need to certify the film they sell in the state. Sticker Requirements No sticker to identify legal tinting is required. Medical Exemption State law does NOT allow medical exemptions that would allow you use special tint .[/quote]

Hey in some places if a cop pulls you over he is expected to give some sort of summons.Perhaps he gave the Tint summons so you can Fight it and Win.

My best friends brother is NJ state police officer and he told about all the tricks they do to let some people off. They just cant let people drive away after a stop.Sometimes they put the wrong court date, so you can win (sexy nice girls get this one).

I would guess you were Not a Jerk to the Cop!

I kept my mouth shut. He said something like i have to take the front tint off show it to any cop have them sign my ticket then go to court and pay like 10 to 20 bucks. He said most people just use a razor blade to take it off. Im pissed thats like $180 peeling off of my window. I've been next to cops before at red lights with my windows up during the day and nothing. This guy gets me at night with my windows down and i have to take it off .

well anyways its nice to be on the forums

you can have up to 30% tint on your front two windows....any idea how dark your tint is?

According to the law posted above you can only have 70% or higher on the front. Tint is measured by the amount of light transmission. 30% would only allow 30% of the light through. The lower the number the less light transmitted. I can tell just by looking at yours that your tint of the front is too dark. So could the cop. You violated the tint law and got caught. Pay the fine and take your lumps.

70% tint is very light. Looking from your pics, you're probably running 35 or 40% on the fronts. It was probably just obvious to the officer... I don't think they need to measure to be sure. It's just like how you can get a ticket for speeding when they don't know exactly how fast you were going, as long as they're confident that you were exceeding the speed limit.

Correct me if I'm wrong, but the ticket is just a "fix it ticket," which means if you can prove that it was within the legal paramaters when installed (like Kimber mentioned) then you should be off the hook for the correction and the administrative fee that's associated with the ticket.

the back is 10% or 5% i think and the front is 15%. The versa does look nice though with the dark windows.

I would just pay the fine and count my blessings that the cop didn't give you a SPEEDING TICKET (which is a moving violation and can affect your insurance rates).

if your back windows are dark and your front ones aren't.... the darkness will spread thru the car

i live in GA and i had 32% on the front, but 5% on all the back windows, and i was pulled over numerous times for them to check

so you might want to get a cop to use the window tint scanning thing to check just how dark they are before you go peeling off anything

Who installed the tint?Do they know the Law?did you ask for something darker?

If they put the wrong thing on your car make them pay and or replace the stuff.

most shop's out here in Cali have you sign a waiver (its part of the receipt) that they are not responsible if you get a ticket.

Yeah... when I got my windows done, they made me sign a waiver that said they communicated the law to me, and if I chose to operate my vehicle on public streets with the windows darker than the law permits then it's my responsibility. However, the shop owner told me that if I ever get a ticket to bring my vehicle back and they'll take it off for no charge.

You need to learn how to talk to cops. You also need to learn the law so they don't mess around with you. If your front windows were down then they can't tell you to put them up. Also you can't be nice to them, everytime I get pulled over I talk to cops like they work for me, usually I leave them confused and I leave without a ticket. lol well not really seeing that I have gotten like 5 tickets in the past 2 years but I have been pulled over like 20 something times (alot for speeding).

2 speeding1 no front lisence plate4 parking tickets (those don't really count)1 exhaust1 running a stop sign (i swear it was hidden)

I keep my tickets and put them on the wall like trophies. But if your tint was illigal there is nothing you can do but fix it. Just be glad he didn't get you for speeding...cause that would have cost alot more.

I have exactly the same V-Brillian Silver, and would luv to tint that dark, but Minnesota law only allows 50%- front and back. (I had a thread that I posted on this yesterday, but it seems to have been removed!?_) Anyway, does anyone have a pic of a V with 50%. I felt that it wouldn't be dark enough, especially to cut the blinding headlights I get in the rear window at night. I live in a hilly area and the light angles can be blinding.

Actually they they have the authority to inspect your vehicle for safety violations, and that includes operation of the windows. I don't know that I'd be taking any kind of advice from someone who puts their tickets on the wall "like trophies." Do us all a favor lain and change your attitude.

Mr. Vargas (lain) has previously mentioned his habit of drinking while under the influence & leaving the scene of an accident.

I doubt he'll change anytime soon - let's face it, he's 22 and brags on the internet about how "street" he is.

lol i wasnt drinking i was stoned...and it wasnt another car or person it was a wall. and i barly hit it...i only took the clear coat off the paint...no dent or scratches...thats how close i was..barly. And I would never drive drunk drunk...maybe drunk...but drunk drunk your just looking to hit something. and try driving while tripping out on halucigens...that was stupid and I would never do that again...made it home safly tho...even tho i had to get on 2 freeways to get home.

If a cop were to ever ask me to roll up my windows I would just simply stay, "Excuse me officer am I being detained or am I free to go." with a huge smile on my face. His only choice from that point is to write me a ticket for what he first pulled me over for...if he just lets me go I would get his badge number and file a harasment case againt him. The only way they can ask you to roll up your window is if you have some dent in your door that might show damage to the window. I also have 2 years of law school so ya...and you havn't been threw what i have been threw...so dont ask me to changed unless you can understand it first hand.

Well I have to say its not a LAW here in NJ. But as my trooper friends says, his Boss wants him to have a ticketable offense (or suspiction of) to pull someone over.

A jerk always get as many tickets as are obvious, someone nice may get a warning and or a defensible ticket. A cute crying girl may walk if it looks Real and is not an act. (a crying guy - needs to be arrrested)!

Your Law school Days have given you a lot hot air!

If do not comply with a officer's request, and you dont have to! But, then you may Lose your PRIVLEDGE to drive, then and there!

Here in Jersey, they may even impound your car till the Judge sorts it all out.

PS. The Judge usually side with the officer!

My wife is a veteran deputy sheriff here in southern California. I showed this thread to some of her co-workers and the almost unanimous reply was (paraphrased),

" For whatever reason the officer decided to cite the guy, but because the was polite enough the cop did him a bit of a favor by writing a fix-it ticket instead of the speeding ticket. However, if he had popped that attitude expressed by "lain" the entire complexion of the traffic stop would change. The cop probably would have responded at that point, "You're free to go AFTER I finish writing you the ticket for speeding!"

Bottom line: Respect the cops and they'll respect you. Cop an attitude and you'll find they have more experience with ways to legally get you. And they usually have the judges on their side when it comes to traffic courts.

And that is the exact response I would expect from a cop and I have no problem with a ticket, but I do have a problem with a cop pushing there limits...remember they are here to serve us...not the other way around.

You can also ask the cop if he balanced his radar that day because they are suppose to every morning and if they did not you can use that on your side in court....everything is documented.

You got to know the law if your going to break it.
