True - but from an insurance perspective, it goes like this (this is based on my dealings when I broadsided the 2nd deer after changing lanes to avoid the first, and talking with the insurance co):
- if you smack the deer, and don't crash into anything else, it's a no-fault accident. Your insurance pays, and your rates don't go up. My car had total coverage, so I dunno if liability only would pay for this (check your policy)
- if you swerve to avoid the deer and wreck, it's now considered the driver's fault, and you may have this considered an accident (just like any other) on your record. In this case, I think that only comprehensive/collision coverage would handle the case (this last statement is my own guess).
It may be possible to get yor insurance company to agree to treat it as a deer accident, but I think they try to cover their asses because there's really no proof of a deer involvement if you don't smack the deer.
The moral of the story is - hit the deer if you are going to hit anything.
