I was heading north on highway 70 from Sacramento to Yuba City. Road was clear, no body in front of me and nobody in the rear, broad daylight. The CHP was coming at me in the southbound lane and I saw him too late. I just pulled over and waited. CHP asked for all my docs and I complied. Wrote me up and sent me on my way.

I did a search and nothing at that speed popped up. Is my license in jeopardy?

Not sure about CA, but in a lot of states the police will either take you to jail and impound the car or make you follow them to the police department for an "arrest". Just getting a ticket makes you very lucky.

I would expect some sort of license suspension, fines and classes to take resulting from this. Your insurance company is going to have a field day.

WOW I am super sorry to hear that...I would of expected him to arrest you for going that fast according to a police officer I spoke with..anything over a 100 mph is an automatic arrest..maybe he gave you a break cuz the road was clear...wow your insurance is going to sky rocket..i hope your license doesnt get suspended..but you might face that consequence..thats what we get for living in the golden state lol..good luck!

I appreciate the information. I'm thinking consulting with an attorney is in order. My job requires travel and a suspended license could really jeapardize my employment.

wow 124?!! i guess norcal is different because in socal i've had friends that were going over 100 and they were arrested. one guy i know was going 110 on the freeway at night when no one was on it and when the cop pulled him over, he told me the cop pointed his gun at him and tackled him to the ground and arrested him. he told me he was charged with a felony even. along with reckless driving and street racing. i dont know what happened because i lost contact with him but youre pretty lucky to walk away with just a ticket. whenever i start to speed, its always on an overpass (on the 110 freeway there is a section where the carpool gets seperated from the rest of the freeway and theres no place for cops to hide). i've heard of a guy that was racing and talked his way out of arrest and instead the cop just gave him a fat speeding ticket for 96mph.

i dont know if 100 is the magic number, i thought anything above 25mph is where you cant take defensive driving, and double the speed limit was an arrest

Boy, at this point, I'm feeling very lucky. No doubt that I will pay close attention to the speed limit. I figured I'd get hauled to the pokey, but the CHP just handed me the ticket to sign and warned of re-entering the road safely. I assumed that I was written up for less than 124 since I wasn't headed to jail. But 124 is written in black and white (ticket is actually yellow). Code reads "22349 (a)vc - exceeding 65 mph." Things could have been much worse, it seems.

In my experience what has worked is pleading guilty and showing up for court. Often a DA will offer you a lesser plea right before trial. Not sure a lawyer is needed for that. What would your defense be???

You should consider yourself blessed a ticket is all you got.

I'm with SVT on this one -I may take it up to 90-100 on occasion - but punching up to 80 is enough most times. Enjoy your car .

In his case, needing to keep his license for employment, he should cover all bases and get as much help as possible regardless of the cost.

About 4 months ago i got a ticket for going 69 on a 35 zone in san francisco. The first thing the cop said to me was that I was going to jail, and that my license would be suspended. Fortunately, he let me off with just a citation, but it was considered a misdemeanor. I hired an attorney for about $1000, and he said he will most likely be able to bring the charge down to an infraction. The case is still pending.

And then about a week ago, I was rushing to the hospital because a family member was in the emergency room. I was going 84 on a 65, and CHP pulled me over and showed no sympathy.

I will most likely get my license suspended. Speeding is not worth it.

Some states consider more than double the speed limit attempted suicide. Either way, yes, your license is in jeopardy. That or you'll get so many points any further infractions will have it taken. Either way your insurance is going to be astronomical. Expect at least $2-300 extra every 6 months....

I understand that my insurance will costs will increase. I'm wondering if the insurance company is notified of my cited speed or if they just get the code violation number indicating "exceeding the speed limit."

I'll start my search for an attorney tomorrow and post up the advice I receive. I appreciate all of your comments.

While I intend to keep my speeds within the posted limits, I think it might also be wise to invest in a decent radar detector just in case I drift more than 5 mph over the limit purely unintentionally.

Any recommendations?

Many years ago I was pulled over by the CHP doing approximately 115 on a motorcycle. It was early on a Sunday morning, with almost no traffic on the fwy. The officer advised me that over 100 was a trip to jail, at her discretion of course. She wrote me for 95, and told me to watch my speed. She could have arrested me, as well as had my bike impounded. The amount of street racing and injuries/deaths associated with it, have caused the state to get really tough on speeding.

You got off easy as far as the ticket goes, but in court you might find that the judge is not as accommodating. An attorney would definitely help, but be ready to shell out some clams... when I got a ticket last year for a right turn on a red light, (at an automated surveillance intersection), I checked into a lawyer and found that it was going to cost me a minimum of $2500.00 to fight it. Maybe you should just bite the bullet ask for leniency from the judge on the first ticket, then pay the fines and go to traffic school on the second one. If I remember correctly, the fines are $5 for every mile over the speed limit, plus the court assessments, which are somewhere between 50 and 100% of the fine.

Good luck whatever you decide.

Oh, and I believe that your insurance only sees what the infraction was, not the circumstances... but don't quote me on that. Anyone here an insurance agent??

Excellent recommendations... I have the Escort. That thing detects from close to two miles away!! The irony is that there are so many false indications due to security systems and door sensors in the city that I am actually driving slower now!

Congrats

In 2003 I got ticketed by motorcycle CHP doing 103mph in a 65mph.

I got a mandatory 6 month liscense suspension and a fine of $380.

You will def get a liscense supension but you fine is looking to be slightly more.

Just go to court and plead no constest. There really is nothing you can do. If you were the only one on the road then it's highly unlikely the cop could have messed up the radar gun shot.

Thanks BigWill. Those links are extremely helpful. Besides speaking with an attorney, my immediate goal is to attempt to calm myself down and lower my blood pressure. I'm just a tad worried and I fear my stomach lining will rapidly deteriorate.

Now that I told you how dumb that was I will tell you how you can possibly get the best outcome when you go to court. TAKE driver improvement class, get a lawyer, stop driving the car if at all an option. Take any reputable individuals you can, whether it is your paster, reverend, parents, children or someone. Expect to get your license suspended for 90 days off the top possibly longer, judge might suspend 60 as long as you don't get another traffic infraction in the next year. Keep in mind these are all if you have a GOOD record +4 or +5. Since you were going that fast I doubt you have a good record though, keep in mind that the driver improvement class is about $65 and it gives you 5 points. The driver improvement class can be taken every two years for points just as a side note. Also bring your wallet because you will have a 3 digit fine if not a 4 digit one, you are so lucky you didn't get that ticket here in VA. The new fines they instituted as of July 1, make a speeding ticket carry civil fines in the thousands.

I suppose I should have expected this kind of unhelpful editorializing. While I agree that my lapse in judgement was indeed stupid, it certainly was not the "stupidest thing" I could have done. And I suppose that generalizing about age is to be expected based on my poor judgement. As for the helpful information from the others on this forum, thanks again. This resource is priceless. I have made contact with an attorney and will meet with him this Friday. His fee is $2000 and indicated up front that he can make no guarantees for me. Still, I feel being represented by a knowledgable attorney is mandatory in this situation. This experience serves as a powerful lesson to me and hopefully to others.

Every juristiction needs dummies for TAZER practice. Offer to get 1 zap per mile per hour over...............the police will talk to judge...............an experience that will last a lifetime.

Ask about public stocking [tomatoes] on the city center there are usually many alternatives ................. dirty jobs around a city that need doing.Do enough and the whole thing might disappear.

I remember 32 years ago when I got a 120 mph ticket.

Right on Joe... rocks and glass houses. That's why I just tried to help the guy. I think that the total experience is going to be plenty to dissuade him from doing that again. Hi all......not to steal your thread with my own question, but I didn't want to start a new one when you've already got this one goin. But here's my situation.

I'm in Oklahoma, and our laws aren't near as crazy as east and west coast, but still for the most part unforgiving. What happened is this......10:30 at night on a 4lane road with 35mph as the speed limit (all safe conditions other than night). No cars on the road within a hundred yards in all directions. Light turned green, I accelerated normally half way through first gear and had a buddy with me so decided to feed some speed to my ride. I punched it through close to the top end of 2nd gear when I saw the cop hiding behind a bldg, just chillin w/out his radar gun on (found out later when he said he didn't know how fast I was going)So of course shifted to 3rd, let off and coasted while he pulled out to pull me over.

Cop seemed pretty cool for the most part and I was respectful. He told me he didn't know how fast I was going but saw me blow by at full throttle (aftermarked exhaust so loud), so basically I'm sure I sounded like I was going faster than I was actually going. If I had to guess I'd say I was going from 50-55, with 60 being the very very most, but not likely. Long story short (sorry) he came back and gave me a reckless driving ticket (pretty much worst you can get thats below a DWI or DUI).....so I'm like WTF! (in my head of course) but signed it anyways...no admission of guilt, but with a court date and option to pay. It's only 289bucks for the ticket...but I'm more worried about insurance and pts on my license. I wanna get a lawyer and fight it, especially since he has no hard proof I was speeding ( I know, my word against his and cop wins) but still, seems extreme to me for what I did.

Well, anyways.....any advice and guidance would be great.

FYI, I'm not a kid :P just an adult that likes to play occasionally!....so no flamin plz
