Some dumbarse girl pulled into a parking spot next to mine and totally scratched up the left side of my car. It's white from the paint being stripped off. I still have to call my insurance company tomorrow. Public safety filed a police report and they took pics of the damage. I have to go out and do that myself tomorrow too. Bleh! And I have two exams tomorrow. Yay!

Ok two questions:

1. Do I also have to contact my insurance company or just hers since my car wasn't moving and it's 100% her fault?

2. The insurance company will probably ask me to take it into a body shop to get an estimate. Any advice on that? i.e. Where do I go? Should I ask them to total it, etc?

There is no need to contact you company unless you have full coverage and her company is not paying up.

If you own the car outright you can take it anywhere or choose not to get it fixed and pocket the cash.

If you go this route coherce the estimate guy at the shop to be very detailed....new door frame or painting the whole side of your car. Just wink your pretty eyes or if your daring show a little skin and he will surely hook you up. That is unless you get some butch girl though.

The insurance company usually gives you a list of shops that they go through near you. When I smashed my mom's old car, they gave us a list of certified shops near us that we could deal with, then we got to pick the one we wanted.

Oh yeah you will probrably have to come up with at least three estimates, then turn these in to her ins. company and the will allow an average of the three.

You should still tell your insurance company as your agent can fight for you vs theirs and keep you from getting screwed.

You call your agent, he'll/she'll call her agent and make things work. You don't want to have to deal with her insurance company, they are evil deceptive bastards. Post some pics of the damage.

I wasn't sure if it was a hit and run last night. But I just got the police report and the ***** didn't even call the cops herself. She left the scene and someone else witnessed the accident because the parking lot was right next to their house and called public safety in. She admitted to hitting the car. THe dumb ***** left me a voicemail today telling me not to go through my insurance company. "I don't think we need to go through the insurance company - i'll just give you like $100 bucks cash" I am so pissed. I wasn't even mad last night but after not doing as well as I should've on my exams and receiving her vmail I am fvcking ticked.__________________

Insurance baby!

Call your agent as previously posted, especially if you don't have the time to deal with it yourself.

It's always easier to deal with your own company. You'll have to lay out the deductible if you want if fixed right away, but your ins co will subrogate and refund it. As long as her company cooperates.

I laugh when people try to settle without the ins co. It always turns out to be like three times what they thought. A little door ding is like $300 nowadays.

Ask for more money(however much YOU think is fair)...

Or tell the insurance company.

Good luck!

Just let your insurance company take care of it. At least you had a witness. Most of us don't even get that. What we do get is a scratch, ding, or dent.

Make sure you tell your agent/claims rep that she admitted fault AND offered you $100 to not report the claim. I'd imagine you've got all that on tape?

Personally, if it were me I'd go through my own insurance company pay the deductible and let them chase her company (if she really has insurance) or her for the money. I'd find out who does the best bodywork in your area (ask around, I'm sure someone knows a good place) and ask if can take your car there.

You may also want to see if your company will pay for a rental vehicle while yours is in the body shop.

definitely save the voice mail. Then call your insurance company and have them deal with hers. You will get your car fixed.

At what point did she admit fault?

Don't assume she even has insurance. If she's uninsured and you don't have UI coverage, $100 might be the most you get out of her.

The incident report states that she admitted to hitting my car and there were two witnesses, one of which is her friend whom she confessed to and the other is a resident of the house next to the lot.

She does have insurance. They called me back today but I didn't have time to call back. I'm not even going to talk to her. I ignored her in ballet class today. I don't have to deal with some dumb slut hitting my PARKED car and trying to lowball me.

Just as expected...if you did contact your insurance already...which I would have advised against, all you did was notify them of a non at fault accident that they will keep on record.

Is her insurance company reputable or have you never heard of it?

I hope you own your car and have the title in hand....if not her insurance company gets to choose where to get it fixed; and it won't be top of the line. But, if you do own it YOU get to choose how and where it is fixed.

So, do you own it outright?

I do have the title on hand. I really don't plan on fixing the car. I am just gonna take the insurance money and save up for something new. There's a guy who was and might still be interested in buying the car.

I don't even need a car. I walk just about everywhere. Only time I use it is during the weekends when I have to get to the barn or I have a tourney to go to.
