heres a few pics, dont really show all the damage, and it looks way worse in person, but thats the jist of it.

Had just gotten out of school and headed towards my friends house.

_______________________|........|_____________________________________me-> __........ ____________________.....................................| exit |...........................................

there's a little half a** diagram, ill explain. the area labeled exit is the exit to the school parking lot, i was coming from the other side of the school heading down the street. I clearly had the right away, but some genious little sop****re thinks its okay to just drive out when im 10 feet away.

i was going around 35, and just before i hit the intersection he pulls out, i try to dodge him but he tbones me.. blows my tire out, bends my rim, destroys my quarter and door. i do a 360 and stop.

Wheel, axel, brakes, body, everything in the rear passenger side area = destroyed beyond fix. also it ripped out my stereo, and tossed my subs around a bit, which now dont work. gah!

now im not too pissed because the engine and transmission are still okay, that i know, and i have another 240 shell at my house, so ill just drop them in it.

but what i want to know, is if im gonna be able to get any money out of this?

I have full coverage, I'm not sure about him. But my car is still on a loan, and it would take ungodly amounts of money to fix it, if even possible. So do I get any money, or does it just slide, because the car can't be fixed anyways. I'm not sure about how insurance works in this situation. If you hadn't figured it out, it was 100% his fault.

Don't flame me telling me to internet it. I'm bored and I figured I'd just tell you the story, and see if you know anything about insurance. :D

His insurance company will pay you fair value for the car. Or should at least.

if you have anything you've done, aftermerket wise, like wheels/overfenders/brakes. Then you need receipts and they can hopefully help reimburse some of that. People like that need beat seriously, smash their window, drag them by the throat, out of the car and f*cking stomp them. That would be worth more to me than a claims check from the insurance company. They'll learn their lesson and drive like they're supposed to....once they learn to walk again first.

As long as you have receipts for the work that youve done, you will get more than what the car is worth... assuming that those parts were damaged.

If you had just gotten out of school, wouldnt the school speed zone be in affect? 15mph?

I dont mean to say that you were speeding, im just curious if I missed something or not.

Schools own certain parts of the roads technically, if it was some sort of complex that had some other streets on it to get out to the main road then it can be whatever speed

Yeah, maybe I misinterpreted the diagram. But its usually any road thats next to or in front of a school that has a speed zone.

nah it was by the highschool but not on a main road so it wasnt a school zone, just a side road, speed limit was 35.

and i dont have reciepts for anything on the car, but none of the aftermarket stuff was damaged except for my subs and and wheel.

will i get time to take out all the things i want from the car before they total it out? or should i be concerned and get it out as quick as possible (engine, transmission ,seats, wheels, etc.)

you will need to buy it back in order to be able to keep the engine. normally they will knock $500 off the settlement and you get to keep the car.

the damage really doesnt look much different than it did before he hit you

its pretty different, but what do you mean knock off the settlement?

can i just go ahead and start talking all the stuff from my car that i want, or will i get in trouble for that.

I think what it is, is that the insurance will give you the money, usually book value, and they will take the car. If you want to keep the car for whatever reason, you either buy it back or deduct the cost form the money the insurance is paying.

Either way, dont expect much from the insurance company.

Unless you had it appraised with all your custom parts then like everyone else says you are going to really get under paid by your insurance company. Either try fixing it or selling pieces for parts. Sorry to hear about it though.

well i have another red 240 that i had before the accident, which i planned on swapping everything over to, now i just have the motivation, since my car is down for the time being, i'll just get it done this week.

but if they take my blue car, then im screwed.

I need the engine and transmission out of it. thats my main issue now that someone here brought it up, keeping my blue car.

i talked to my insurance company and he said that i should have the option to keep my car, but if i dont have that option, then i have to buy it back, and i dont have the money to do that, so im just hoping i get the better end of this.

theres the red one.

If they totaled your car out, and they're going to cut you a check. You probably can buy your car back from the insurance company before they even remove it from your possession for a few hundred bucks. They just give you a smaller check for the full-coverage you had, since you keep the heap.

Ummm... noone asked the obvious question... Did YOU CONTACT HIS INSURANCE COMPANY?? Also, they will try to lowball you in the beginning... They want the settlement to be fast and cheap. It's like buying a car but the opposite... Now you're the dealer... trying to get the most you can for the car... I had a $500 invested in a '91 mitsu eclipse... I got $1400 and kept the car when I got t-boned... Sold the car for $300 Their original offer for the car was $500 You just have to be smart. Either way, good luck

well i worked on the car all day today and i will have everything, engine and transmission included, out of the totaled car in the next two days most likely, so i wont need the car. should i throw all the stuff from the red car into the blue one and just let them total it out? (stock seats, blown engine and transmission)

and anyones opinion on the wheels, should i use the gold ones or my enkeis?
