My Worst Night Ever- The end of my 240.

Please gather tissues, and get ready to cry. I will try to make this as short as possible, and due to the fact that i am very tired, and not in the mood. So this is how it happened, me and my girlfriend meet all our friends at our local hangout called streets of woodfield. There is a starbucks there that we all hang out at. So we are up there hanging out, well about 12:30 at night i decide to take her home, because i have to work in the morning, and she has tennis practice. Well taking her home i i90, a major 4 lane highway, she is dozing off, im wide awake, due to starbucks. Well i90 is under construction. This comes into the story later. Well right after the toll both a semi gets over in the left lane, of the 4 lane rd. Well i get all the way over to the right lane. And am passing the semi but keeping up with traffic. All of a sudden a pick up swerves into the front driver side fender of my car, hitting me onto the sholder. Well i slam on the brakes, trying to slow down as quick as possible. Due to the highway being under construction, there were 20-30 foot lightpoles semi on the sholder leading to the grass. Well i rode up the lightpoles into the grass, hiting a big mound of dirt, When we hit the mound, the car rolled over onto the roof. And slid to a stop back on the shoulder. The good news is, me and my girlfriend walk away fine. I crawled out the back windshield. Fought with her door, and got her out of the car. There were a bunch of people that stopped, and were my i witnesses. The cops told me they gave the same story as i did, but i have not seen a police report yet. We both went to the hospital. She got checked out due to a history of back pain, and they clean off my hand due to a little cut. Bad news is the car that ran me off the road never stopped. It wasd a hit and run, and we dont have the plate. I am praying to god that we can identify the trunk on the video from the toll both. The cop said they might be able to, but i will have to see where that goes. I wanted to say thank you guys for all your support, help, and the great tims on nico. I will prolly still visit the 240 boards frequintley due to my love of the car. Maybe some day in the future i will import an s15, but for now no more sports cars for me. I need a HUMMER!. I would of ran over this muther ****er. Sorry for the language. I am very scared at what my insurance company is going to say, due to the fact that there is no other car so far. and my insurance company is going to be the one paying.My father suggested to me that i should try to find a lawyer to help me with the case, and possible file a law suit for hit and run and he said possible attempted man slaughter? im 19, dont know alot about lawsuites, what due you guys think about this. My friend took pictures my car sitting on the side of the road. When you guys see these you wont believe both of us walked away from the car. I will take more pictures of the car 2 morrow, at the yard that its at. Well thats all that i can think of right now. Im sure i will reply alot to this thread with updates and such. For now, i am going to bed, and going to go take an ish load of advil to try to realive some of the pain im starting to feel. Later guys, Chris

Man that sucks. Good to hear you and your girl are ok. If you can find the driver of the truck you might have a case.

yeah, good thing you and her are ok. i wonder what was going through the girlfriends head...she was sleeping, then all of sudden-WTF!!

if you want to get a lawyer, just look in the phonebook for an automobile type law firm and give those people a call. i'm sure they'd be willing to listen and help, because that means money for them too if they win.

Wow, you guys are up all hours of the day like me :). I cant sleep. I keep seeing it happen over and over in my head. I feel like i should of done something different. I feel horrible. Im so sorry i had to due this to my girlfriend and her family. I had to call them at like 1:30 in the morning and say, umm well i rolled my car that your daughter was in. AHHHHHHHHHHh............................... I already just want this all to be over and this experience to pass. I am horrified to even think about getting in a car, let alone drive one. I really dont want to deal with state farm. O well. I guess i just got to deal with it. Life really can sucks some times. But im ok, physically i guess. Life will go on, Chris.

The important thing is that you two are ok. I'm sorry about your car and you might not be the same, driving wise, for a while though. Hope you find that SOB.

Quick Question?..... Have any of you guys ever been in an accident, or totaled a car and had modifications done to it. Did the insurance cover it. I was told by my agent if i have reciepts it would be covered but i am kinda worried, i wont get that much from my car. Thanks, guys. Chris

Hey, good to hear your doing well after the accident.

I have gotten into an accident with a modified car before. The insurance company did cover all the modifications ( but they did ask for receipts ). However, the insurance company that paid for everything wasn't my company, it was the person's who hit me.

I'm with Geico now, and they had a form for me to fill out when i started my policy specifically asking for any modifications. They said if I didn't list any modifications on the car, that they would not be covered in the event of an accident.

As far as suing for "attempted manslaughter" , I really don't think there's such a thing as "attempted manslaughter". Part of the defintion of manslaughter is that the resulting death was not intentional. If he attempted to kill you, thats attempted murder, and thats not something you sue for, thats something you get arrested for.

Ok, well i am with state farm, i am just hoping they dont try to pull some bull****,t hat they wont cover the car because it was modified with competetion parts or anything. I was looking over my reciepts for the engine swap. And it says that competition parts may not be inteded for street use, and may be illegal. But no where on there does it say the sr20det is competition engine, or any parts are competition parts. So to the insurance company couldn't i say my engine blew, which it did, so they put a new one in, and nothing more. It was a smaller motor 2 liter instead of 2.4 and is slower blah blah blah. What do you guys think?

Can you buy back the car and remove the parts from it?? If your company allows you to do this, you could buy the car for next to nothing. Cause I would definately try to get atleast the motor out of the car.

Im considering it.. but i dont know what kinda condition the motor will be in. As most of you know, with the greddy front mount you have to remove the front bumper support, so i didn't see how bad the front of the car was, but saw the fmic was almost ripped in half. i am strongly considering it, but im not sure if the motor is salvedgeable.

man that sucks so much. I'm glad to hear you are both alright, but the loss of your car is horrible! It was such a nice car! I hope you can ID the truck and sue his *** off for hit and run and even the attempted manslaughter. I would definately consult a lawyer on this, its the best way to get money. Good luck, hopefully neither of you have recurring injuries.

I'd definitely try to buy the car back and part it out. As for the insurance, I don't think you have to worry about the claim being denied. It was a hit and run and the police report is in your favor. As for the modifications, it depends on the company and the claims adjustor. It's a good sign if your agent thinks you'll be OK.

Even if you don't get as much as you wanted on the mods, you can always make some of that money back by buying the car back and parting it out. Someone I work with just did this with a mint Fiero that his son totalled (small mid-engine RWD for a first car = not good idea).

Anyway, glad to hear that you and your girlfriend are OK.

damn dude, sorry to hear about your misfortune, but at least you guys are all right. I know I felt like total s*** a couple days after I wrecked my 240, and it was fixable. cant imagine what you must feel like. I had state farm too and they would have let me buy the car if it was totalled, so I would advise doing that. also, you should post some pics of it so we can see what really happened and how lucky you are.

You definatly have a case against the guy in the truck, it sounds like he broke ALOT of laws.

See what the insurance company wants to give you and determine if its worth it to buy back. IF the car still runs i say it would be worth it to buy back just for motor, motor parts, and salvagable exterior parts, all the interior tid bits etc. It might take a while but generally people make more money off of parting off cars than they would from the insurance company just paying them. At least this would allow you to keep hard to find parts for your next 240 (at least i hope your concidering buying another 240, this was in no way your fault)

I've seen people buy back cars for like $200 then part out whats left for $2000 or more. its usually worth it if you've got the time and ability to strip it. Hell, the parts alone on your motor are worth more the the whole.

One note about State Farm. Yeah, they'll pay if you have receipts, but they will also drop you for "Modified Vehicle" if they see fit. I had a custom Accord that I had done a motor swap to, had a NX wet kit on, lowered, 17's molded in bodykit, and a custom paint job. I lost traction in the rain and slid into an F250. I did maybe $500 in damage to his truck, but close to $2000 to my car. They paid me but about 2 weeks later I get a notice in the mail that I'm being dropped due to "Modified Vehicle".

Either way they'll pay you, but finding another insurance company is a pain in the *** sometimes.

State Farm is horrible about dropping people...good luck with them! On August 28th I'll no longer be insured...thats when State Farm officially drops me. At least you guys are allright, I sure do hope they can ID that pickup, keep us updated on what happens with it!

Yep state farm suck, they will ruin your life even if you and/or your family have been insured with them forever!

Good to know that your girlfriend and you walked away fine from the crash though. Car can always be replaced...life is more important.

Yeah, we've had ALL of our insurance with them for something like 20 years...but when I have one wreck (yes, my fault, totalled the car) and two tickets within a year in the last 3 years...they dropped me. One question BP2000...how'd the roof of the 240 hold up to the rollover? My girlfriend has been terrified of riding with me in other cars since I rolled the Blazer with her in it. I'm hoping I can tell her that the 240 is safe in a rollover and she wont worry as much riding with me when it's up and running. (not that I plan to roll it)

State farm didnt drop me for modified vehicle, altho all I had was a 500 dollar suspension and an aftermarket sunroof :)

Well right now in reciprts i have over 9 thousand dollars so far, and i am missing a couple. I might hit the 10 k mark. I just got back from getting some items out of the car and all i gota say is wow. I will post 1 small pic now, i have many more, thatll ill upload to my work server when i have some time. and to answer your ? about how the car holds up in a roll. I would say good because me and my gf walked away with only scratches, but when i look at these pics and my car, i honestly think someone for some reason was watching over me, i dont know how we walked away. Here is a side pic.

No offense man, but almost any standard insurance company would nonrenew your policy for 2 tickets and an accident within three years, especially if you're a less experienced (say, under 25 YO) driver.

As far as the company is concerned, they no longer have a rate adequate for the risk you present. Insurance companies are businesses, and they won't write that policy if they think there's a good chance they'll lose their shirts on it.

Different companies are in the market for different things, so you'll certainly find a company who will write a policy for you. You *may* have to go with a non-standard carrier. The market is *very* tough right now.
