How long after a newly purchased Infiniti do you have to return the car because you're not satisfied?

I purchased a 2011 G37xS a week ago and have had 3 occurances when the transmission bucked from 2nd to 1st gear.

I checked with the service department and they stated that the transmission software was up to date.

I've got a loaner right now and I'm going to test the transmission in this compared to my car while they try to reproduce the problem.

I want to act now so I'm going to contact the BBB tomorrow but I'd like to know if I can simply get a refund instead as well and how much time you normally have after a new car purchase to get that refund.

Thanks,

Jim

Is it happening when you shift manually? Asking because you shouldn't have to shift to 1st unless you stop. 1st gear is too short for anything else but start rolling the car. If it happens in sporrt mode or D it could be your ECU still learning your driving style.

I have it in D mode and I have a 2011 G37 loaner with 5G's on it.

I already notice a difference in transmission shifting but I'll circle back around once I drive it some more.

Do you know how long I have to get a full refund on this car purchase by chance?

Thanks,

Jim

I know that when I traded by g35x for the 2011 G37x I noticed with the auto trans that there seemed to be a small delay in shifting when slowing which almost seems like a power lag.

Anyway, to aswer your question it is highly unlikely that infinity will take a car back without some pressure exerted on them. I would do two things. First call an attorney who takes lemon law cases and do a free consult with him or her. That way you know the law as they vary widely. In Mass you have to try to have the car fixed 3 times. You can then build a case and have the paperwork to prove it if it comes to a battle. That said battles are always bad so I would insist that infiniti have an upper level tech who works region wide come to the dealer and you have him drive the car with you there. I did that when my mother was having problems with her (non-infinity) and the tech knew the problem in 2 minutes eventhough the dealer tried 5 times to fix it without success.

Like the guys have said, really it's very difficult and sometimes expensive (lawyers) to make a vehicle a "lemon". It usually takes multiple issues with little help from the dealership to even start to think about it. You may be thinking of buying a home...I believe it is possible to back out of the contract within 3 days of closing...it may depend on the state. Cars do not have such laws and it's really as-is, even for new ones.

But...lets examine the issue. Have a tech do a ride-along with you and show him what your talking about. Worst case is they will replace the transmission...not the car.

How about "very little chance of a refund" happening at all.

Based on your IP it seems you may be from Georgia. If that's the case, there is no "cooling off period", thus, you signed a contract on the car you are liable for said contract. Now, GA does have a lemon law but you simply can't invoke it because you want out of the contract.

In general you are stuck with your purchase. You can trade it in and lose money or even sell it at a loss if you want. The BBB is going to do very little and if the dealership is following state and federal guidelines then they will not be found at fault. My suggestion is to work with the dealership to get issues resolved.

im pretty sure your hard 2 to 1 shift will smooth out once the ECU/TCU learn your driving style, and they should be able to change your transmission software... i have the 2010 G37x and have had zero transmission problems. im at 32k miles.

i highly doubt you will be able to return the car just based on a very fixable transmission shifting issue.

My question is do you like the car at all? past the shifting issue you are getting...

Thanks for everyone's replies.

I should have purchased a sick. I repro'd the issue with my loaner today however the "buck" wasn't as hard. It's obvious that the transmission's have issues.

I had the tech check the transmission soft version and it's up to date which made me quite upset.

I'm from CT btw.

And finally and not in the proper order, I love the car other than the transmission issue.

I'm going to see if the tech can "re-flash" the transmission or something when I pick it up after a few days of having it in the shop. Man I hope the tech's don't beat on my car. That's one of my worst fears.

CT doesn't have a cooling off period either, and here is their lemon laws for reference: http://www.ct.gov/dcp/cwp/view.asp?a=1646&Q=273788 :)

Good luck with it, I hope they do find something wrong because you should not be having these issues.

I have this same model. It seems to sometimes have a hard shift from a low gear to a higher gear while driving normally. Mine is an automatic, and also if I get on it pretty hard sometimes there is a little bit of lag time from gas pedal to throttle.

Occasional lag is something that does annoy me. Would have to step up to a higher-cost transmission to really resolve that particular issue.

Isn't the throttle lag caused by the drive by wire system being slow rather than the transmission? I used to have the same issue, but the lag disappeared cause I regularly flog my car While getting on the highway.... the ecu adapted finally.

Yes and no. "Learning" can be an issue but is not all of it. I do a mixture of highway and city travel (80% highway) and when not on the highway I'm not easy on it. BUT...it can still get lost between gears, shift slow, and have issues with downshifts. A lot of it is computer but not all. We need a Dual clutch sequential transmission and 400hp :)

I know they're telling you the software is up to date, but you may want to ask specifically about this TSB:
ITB10-075
2009–2011 INFINITI G37, 2011 G25; TRANSMISSION SHIFT ISSUES AND/OR A/T DTC STORED
Any of these incorrect gear ratio DTCs stored: P0732, P0733, P0734, P0735, P0729, and/or P1734.
and/or
A slight vehicle vibration/shutter with light acceleration at low speeds,
and/or
At times, the engine rpm goes up (about 200 to 250 rpm) during the 3rd > 4th up shift, or the 4th > 5th up shift,
and/or
Engine braking feel is more than expected with deceleration,
and/or
The 2nd > 1st down shift is harsher than expected

That would be the GTR37, wouldn't it? I'd love to have those, don't get me wrong, but I don't want to pay $50K more.

The transmissions tend to shift a little funny sometimes especially when new.

To the OP I bet your average speed and economy rating are still something crazy that set during transport.

Since it seems you might be stuck with it just take solace in the fact the warranty will cover any issue. There are systems to monitor systems in your car. The car will actually know before you do that something is wrong and will warn you with a light.

Agreed, the original was a blast to drive. But it is noisy and expensive to maintain. That much power requires expensive tires and brakes. I'll wait till a gtr goes out of warranty and pick one up 8 years from now.

I'm seriously considering one for my next car...probably will be used though. I'm thinking a 2012 model 4 years from now ;)

How old are you? I had some of those in the day--396 Super Sports, 351 Clevelands, live rear axles, watching things go _away_ from me through the windshield at 80+ mph. I remember the night I was riding shotgun when Kenny blew a tire on a Firebird 400 at ~140. He said "What do I do now?". I said, "Stop the car". The tire was on fire by the time we got to a halt. Too much fun for me any more. They all required insane reflexes to control.

That said, I seriously considered going with a Mustang GT and a used 4wd pickup in lieu of my G37x.

Was the Pontiac 400 a small block? How do you go that fast with only a few gears? All in the rear?

How do you feel about the decision to go with the G, so far?

IIRC, the Pontiacs had the same block from 326-455 CID, there wasn't a "small block". That Firebird was a '69 Ram Air IV. He had to order it and wait six months. It was a 4 speed manual, don't know the gear or rear axle ratios, or whether he had done anything with the rear. Had 160 on the speedo, and I was watching it when it hit 140 that night. Don't recall if he'd done anything with the tires, so that might not have been accurate.

So far, I love the G, except for the sub-par stereo. It's a terrific value for what you get, and about as fast as my 57-year-old reflexes will handle. The Mustang GT might have killed me.

My HS parking lot was full of muscle back in the day....wish I had taken pics!!!! :yesnod
I had a 69 Mach 1 w/ 351W and shaker. There were also 2 other 69 Machs and a Boss 302.
One of my friends had a built 455SD TA...it was the year that came white with two blue stripes....VERY fast. Remember cruising the local drive-in on Fri/Sat...There would be a long line just to go thru. Cheap gas & high octane leaded!
The 5.0 keeps calling.....

Until you wrote that, I didn't realize they'd built a Mach I with a Windsor, thought they were all Clevelands (googled it and you're right, of course). Not knocking the Windsor, but the Cleveland was designed for racing. Pull the heads off and you found all the machining for four bolt mains and racing heads. The Windsor was known for holding up better, though.
