Okay, so it's friday night,( 9:30) and im cruizin along. I pull up to a stop sign jammin, cuz it's friday, and i start to pull forward, cuz it's friday, and all the sudden i get alot of help from a maxima doing like 50 and drunk, cuz it's friday. So he smacks into me and i fly through the intersection onto a little curb on the side of the street cuz it's friday. I sit there a second and try to figure out if this really is a friday night cuz this really sucks. So i get out to see what the hell happened and the guy in the maxima takes off. I guess cuz it was friday but i think he was just a jerk. Who knows. I ran after the guy for about 30ft and decided a 2 liter is alot more than 2 legs. So i ran to my brothers house which was like 20 ft away and he was awake cuz it was friday. And i tell him all the $hit that just went down and he took off like a bat outa hell on the phone with the cops cuz it's friday and all. The cops show up at the corner and ask me all kinds of questions. Then my brother calls and is like hey, he's on 121 in The Colony doing like 20mph. His car is JACKED! He hit another car only one not as forgiving as mine. Expeditions are well built cars and lemme tell ya. There wasn't much left of the maxima after that. He was still driving tho. My brother passed him and got in front of him and was leading/following him untill the cops got there. They took him in, he went to jail cuz he was drunk, cuz it was friday. So i call monday morning about the accident report and GOOD NEWS! The guy doens't have insurance. Well now my '95 240 is toasted in the rear end and i have no car and no means of repairing the half of one in my possession. I only have liability so im screwed there as well. WELL HAPPY FROCKIN FRIDAY TOM! So the REST of the car is for sale if anyone wants to buy it. I'll take 1000 for it as is. I posted it for sale earlier in this forum. Just search under velox and there's a '95 under there somewhere. Well anyways, im gonna get back to work cuz it's only Tuesday. Yes you can, how much $ would he end up with tho?

Uninsured motorist = $0 Lawyer fees = $2000+

Usually the uninsured motorist would have to pay out of pocket, but if he has 2 cents to his name then tough luck.

I live in Dallas but the car is in North Plano. I havn't done anything to the car. About the luck part yeah, it's true. I've decided to get an old piece of $hit van. A black one. With the sliding door. Yeah, you know what im talking about.

im sorry to hear that man, u should just beat the **** outta the guy, thats prolly the most ur gonna get outta him. but the sad part is that the local gov'ts are gonna get a lot of money, here in cali u should budget $5k for a dd incident if ur the drunk, why should the state get all that money? life sucks

hey i got a similar story...

i got hit on wednesday night, i was stopped ready to make a turn when i look into my rear view mirror and watch a jeep wrangler slide into the back of me....at about 50

he didnt have insurance but sense im under my moms name she had uninsured motorist insurance... thank god

but the car that got totaled was my ****ty cavalier and now i have a 240sx

so other than the pain i came out pretty well

You can take the guy to court for your damages. You can probably get a verdict in your favor along with an award. Whether this person can pay the award is another thing. But if he works and he doesn't pay, the court may be able to step in and garnish wages. In CA, the courts may force the drunk driver to pay restitution for damages to property he caused in the course of drunk driving. I am not familiar with other states, but it's worth looking into. And if the damages are low enough to keep the case in small claims, you should not need an attorney, and I doubt you will have a difficult time proving liability in this case.

Man take him to court haha you dont need a lawyer just go in there with all the docs and **** and let the judge see it its practically in your favor anyways. Some drunk hit you going 50? Hmm I doubt the judge has to take a second look at that.

I'm telling you, take him to court. Have the police report. The insurance claim, and all that **** and he has to be able to pay when he is sued. If he doesn't he pays over time. You don't just get off because you don't have any money on you at the time.

Do you know what the driver of the OTHER car he hit is gonna do in terms of legal action? I know that it prolly wasn't damaged half as bad as your car, but...

Okay guys, here's the update. Im still sore as hell. My legs now hurt from the accident. I don't know what that's all about. Got some happy pain pills tho so i can't complain. I've got health insurance thank god so the doc. bills won't be too expensive for me. I have a consultation with one the best lawyers in all of Texas. JIM ADLER THE TEXAS HAMMER. He said he'd do it on continjency so WOO HOO. I'll let you know how that goes.

Okay, as far as parts. I gotta talk to my bro about parting it out cuz it's in his garage. I'd need to keep it there untill it was stripped or sold and i can imagine that's gonna take a while. But in the mean time the wheels are for sale. Their 19" Velox VX-5's. Make offers on them and i can negotiate. Just remember they're $1600 without rubber new! Two front rims come with rubber. Rears are a little on the bald side cuz....well....c'mon guys, it's a 240.

The shifter is an after market MOMO nob, with matching MOMO boot. The nob was $85, and the boot was $45. Make me an offer for the trim piece and the shifter stuff. All interior IS for sale. Except for driver seet. Anything that you don't need to drive on the road is for sale. Rear seats and all interior are in PERFECT condition! I hate shipping crap but as long as you pay for it, well that's just super.:ylsuper

Wait a second, I know the Maxima didn't have insurance, but did you? I mean, yeah it will go on your insurance record, your rates may go up a little, but even if you back into a pole you can file an insurance claim and have your car fixed. Am I wrong here? I go my truck hit and run twice in its first year of ownership. The only thing that stopped me from filling a claim was each damage was under my deductable.

Ok, that aside, if you are parting it out, I want your engine, how much?

In my case no. I don't have uninsured motorist coverage cuz my ex-insurance company didn't include that in my policy. After all, why would it when i only pay $165 a month for liability? I mean seriously, wtf does it take to get a break around here? Engine goes complete for $500 plus shipping. I live in Dallas tho and pullin engines isn't exactly my hobby so you'll have to figure out what you wanna do about that. It's a five speed if you want the transmission too. I'll throw that in for $300+shipping if you want it with the motor, but again pullin that crap out aint my expertise. Anyways, if anybodys interested just e-mail me, [email protected]

Insurance should not go up just because you have an accident. Insurance goes up if it puts you in a higher risk tier. If you are not at fault, there should be no effect.
