Hey man, just read your story.
I know what you're going through. My 98 kouki was almost considered totaled by Geico around the same time, like October of last year.
I was rear ended going 20 mph by a chick talking on her cell phone driving a Ford Explorer, which scraped up the rear bumper (didn't look too bad honestly, it didn't even pop loose) bent the trunk lid upwards, and bent the right frame rail. And I was pushed into the rear of a PT Cruiser driven by an old lady.
As the girl and I got out, the old lady in front looked at her rear bumper, decided it was fine then drove off before I could get her tags. I was so furious about getting hit I couldn't think straight. I didn't think my rear damage was bad, just the trunklid was out of alignment. My front bumper had a crack in it, was loose and had paint scrapes from the odd shaped PT Cruiser bumper. I didn't notice the slight inward flexing of the passenger side rear quarter panel below the rear C pillar, along the body groove.
I'd never been in an accident before so I DIDN'T call the cops. Bad move on my part. I got the girls insurance info and reported the accident to Geico the next day. The girl was all apologetic and cooperative. Thankfully Geico stayed after her company, even though I didn't have a police report and finally got her and her co. to admit to responsibility for the rear damage.
I couldn't prove the girl pushed me into the PT Cruiser. She didn't fess up to that and her insurance claimed no responsibility. So Geico ended up covering me for $400 in damage to the front, and repaired the rear at a cost of $3,300.
Geico's body shop said I had a 50-50 chance of there being too much frame damage to repair. But in the end all I paid was a $250 dollar deductible on $3,700 dollars in damage.
I consider myself lucky. Did you end up going to court? Did the old lady get a DUI? How much was the actual damage to your car?
