Thats stupid. You'd be better off with a $25 one from ebay. My buddy had one on his SRT4 and it was badass'er with the flip of a switch, tho I dont know who made it. They all will leak slightly at the butterfly. Just use a good gasket and an e-cuttout that is thick with good fitment (ie namebrand). Emissions are one reason I could see. Also there are times when I know I would much rather have a quiet exhaust. My s13 has a headerback on it and it is way too loud for my personal tastes on a daily.
