***Edited for clarity and sanity***

So, I didn't owe anything in taxes this year. Big deal. Apparently the gov has set something up where I can get $600 extra just to help out the economy, yay!

I *had* a defaulted loan for school that I lost track of back a few years ago and I was finishing up (on the last 1 week of) a "loan rehabilitation" program which takes 9 months total, or I was told anyways.

I was told by my adviser that since I didn't owe this year, I could file late and still get all the money from my refund and my stimulus payment mailed to me and I would receive it in full, just as long as the timing was right.

So I thought I timed all this ish right when I get a notice in the mail (only 1 week after I mailed the taxes ) saying that my refund is going to be captured by the US Dept. of Education for the loan I had just almost finished rehabilitating the status of!! *(at the time of mailing the letter I mean)*

They also say they are going to mail out the stimulus payment in 1 week and its too soon! Why the **** should I have topay $600 to the gov when I am already in the clear?!?

The IRS lady on the phone says it takes up to 4 weeks to process the fact that I am now a good little taxpayer instead of a burden on the state, and apparently its going to cost me the full $911 ($311 refund + $600 stimulus) since they are slow as molasses when it comes to other peoples money.

**** the IRS. I'm never paying taxes again.

SO its OK for them to screw me over for money, but I can't do it back?

I have purposely over-paid every year to eliminate the problem of owing taxes, and this is how they re-pay me? By stealing whats mine? Even when I am in a program THEY recommended?

Yeah, sucks like crazy. Unfortunately if you don't let them have at your corn hole they can put you in jail where someone even bigger and scarier will have at your corn hole.

It's our lovely Government for ya. If I had my way there would be no Income tax since it IS illegal according to the Constitution.

But, you might as well be happy because if you don't pay it you will get your *** raped by the IRS.

And if any agency knows how to slay your corn hole, its the IRS.

**ck the IRS. That's complete bull.

They shouldn't be able to take a single penny over what you owe. The stimulus, while a great idea, was horribly executed. Many billions were seized before they ever got to the spending public - the WHOLE point of the stimulus was to help the economy as a whole, not the indivual.

*sigh*

Umm - can you show me where it is illegal to pay taxes? That's news to me...

Quite frankly, I would punch your "advisor" in the face. Filing late is a bad idea no matter whether you owe or not, and the fact that you had the outstanding defaulted loan didn't help...I'm sorry this is all happening, becuase it sucks. Hopefully it will get better somehow...

No you still don't get it. Filing late is not why I was penalized. Its because I filed too early expecting them to take a long time like they always do.

Get it now?

Datt, please explain the money involved and how the $600 turned into $911. There just isn't enough info in your OP to know what advice to give.

I'd like to be able to say you can get an accountant and have them re-file your taxes, but I don't know if that will work without knowing the rest of the situation.

Quite frankly, the IRS, nor any other company can have a turn around time this quick. This notice was most likely generated prior to you even sending your taxes in, not due to you filing your taxes late at the advice of your advisor. I agree with Reverend D on this and say that filing late is never a good idea - if you filed on time, you most likely would not have gotten caught up in this.

I am involved in a loan rehabilitation program which brings defaulted loans out of default status and back to normal.

I didn't owe any taxes, therefore filing late is not a problem. No late fees or anything.

I was informed by my rehabilitation adviser that I needed to wait until my program was finished to file my taxes or I wouldn't get my money. I was informed that I should file about 1 month before the economic stimulus option ran out to be sure I would get the extra money.

I filed in the time suggested and now its almost like they lied just to get the money back.

NOW do you get it?

You sir, are a god among Constitutional scholars...

Amendment XVI

The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several states, and without regard to any census or enumeration.

Yep.

But the details of that amendment passing were very sketchy. Not that they were hard to come by, but rather the other meaning of sketchy.

It's really, really hard to pass an amendment. I don't know what you think is sketchy about it, please expound.

I suspect it was past to pay for the upcoming WWI.

Kind of. But it was never technically ratified following the correct procedure. There's alot of stuff around about it.

No, no. I had a refund for $311 and the stimulus payment was $600. I can do math.
