Ok, my short attention span instructed me to stop reading about halfway through the thread, as usual, but I want you to find out who the complainer(s) is/are. :D

Wise move, spend the time reading about your local ordinances. It might be worth getting copies/reprints from the local law enforcement for the next time the tow boy comes acalling.

talk to my lawyer, his names remmington. he's got a 12 gauge reason why your gonna shut the **** up.

Amen brotha... amen!

I have always and will always live in the woods for that reason exactly. I don't like neighbors anyway.... especially ones that think my business should be their concern.

I didn't read this whole thread. But you can't fight the association, if your family signed something that said you couldn't have broken down cars around, then you can't. Sorry. it sucks, but they have their little community to protect the neighbors from nuisances like you (yes, I'm kidding, but thats how they see it).Anyway I've never seen an association that didn't allow CARS in the DRIVEWAY, so that seems like its crazy. But if thats in the rules then there is nothing you can do but put it in the garage.

he just needs to read the contract of his homeowners association. And familiarize himself with the laws and court cases of his state. In some areas, people have successfully sued their homeowners associations for similar actions. Its gonna take some time and some work.

I really don't feel like typing the bylaws out so heres the cliff notes version:

My unit (house) runs to the curb on both streets. Car is parked inside my unit. Association controls parking outside of my unit, and thats it. I could park a semi in my driveway, and they couldn't say **** because its on my driveway. So they are trying to illegally tow my car.

Owned.

Cool, so if they tow your car you can charge them with Grand theft auto?

Not GTA, but they could be charged with unlawful detainer of property, which is when the accused believes that they had/have a legal right to seize or detain the property, but in reality they do not. MUCH different from GTA, which involves an intent to permanently seperate the property from its lawful owner.

Either way, to tow that car they have to damage 2 others, which means big lawsuit.

Kick their *** seabass!

I think that if they tried to pull that stunt on me. Either 1. they'd get the idea and go away or 2. I'd be knockin some heads (preservation of property).

Hell even my mom doesn't touch my car :)

Update:Talked to the VP of the HOA (my good friend), and he said that he called in for two of the abandoned cars on the street (a mercury cougar, and some pos daihatsu). He's been helping me out with this project anyways, so it would be just a tad stupid of him to call it in. The association acted on his own for this one, so he's about to get on their *** about it. I'll hear the outcome in another hour or so.

First you need to get a copy of the association bylaws. Home owner associations have all sorts of stupid rules. However, if the set of rules that you get are lacking any provisions about working on your vehicle, then they have no legal right to get rid of it.

Unless the laws specifically say that they can tow it, then they are not allowed it tow it out of your driveway.

If your car is unregistered and parked on the street, they CAN tow it.

In most situations like you're in, the provisions are more geared toward making your parents pay fines, as opposed to giving the association the right to have your car towed.

I feel your pain. I got my car towed literally the second day I was living at my last house. It was a primer grey, loud as hell Datsun 510. The neighbors called. My tags were expired so the police towed it. I haven't lived there for five years at this point... I think it's time to go back and pay the neighbor a visit. :icesangel

My best friend live in a community where you cannot park on the street. Her parents said the home owners people said that any car parked on the street will be towed at the homeowners expense. There are plenty of car parked on the side streets, but non on the main streets around the place. Once I did a 180 in her cold-e-sac. I made sure I parked infront of her neighbors townhouse till the angry nighbor who saw it went back in, HEE HEE. Some home owners people are cool, but a lot are run by the people who live in the cummunity and are just on a power trip, and making judgments based on their analysis of the situatuation instead of fallowing the real rules and hoping to get away with it. Then in some cases it is purley political and some board memeber is trying to get elected into a higher position, by proving to everyone that they can "clean things up".

In the case that you are wrong with them not wanting a "project car" in the neighborhood. Then they should atleast accept that even though they are right, that they should extend you the curtesy of being able to enjoy fixing your own car. i am sure if some guy was fixing up a 72 VETT people wouldent mind as much.

One thing that you do need to realise though. Although you are looking at the situation through your eyes, try looking at it though their eyes. to be able to fight them you have to realize that many people who move into HOA communities move there because they are trying to live a cookiecutter life, and don't want to look at a 240sx, they would rathe look at there rs6. You get my point. I am not saying I agree with them, but you have to realize "why" they are doing this.

I had all those problems doing my swap. They never came onto my property to tow my car away but I got incessant notices telling me I couldn't have it on jacks, without wheels, uncovered, no plates, etc etc etc. I got it off the jacks with the suspension back together and plates on it, like, the day before I was gonna get fined and hit with legal problems :evilhaha:

Hows the RB doing right now? You still need that coolant overflow tank?

Still no word, I'm heading out to school, leaving it blocked in. That car better be there when I get back.

Doing great, I finally drove the car :D Had some overheating problems, but between replacing the thermostat, adjusting the fan thermo, fixing the coolant leaks, adding a 1.3 bar rad cap, and filling the coolant system (since it was only, like, 1/2 full when I drove it :(), I should be fine in a couple days.

And nope, I found a tank in really nice condition from Witchduck for like $10 :D
