Grrr.

The insurance company doesn't "say" you fled the scene - The law does. Have your frind go to the local law library and check the state statutes on leaving the scene of an accident. The crime has already been committed - He just put his own insurance company in a really sh!tty situation by not sticking around until the cops arrived.

Insurance companies have varying timelines for the requirement to report.

Well, he technically already fled teh scene because there was no police report filed. If he turns it into his insurance company at least it would show he wasn't trying to evade a police report and he can claim that it was just agreed that everyone would call their insurance. And since its on record with the insurance company, the other guy can't come back and say that he ran away and didn't give his info or anything.

but if he's exchanged info with the ppl involved in the accident, would it still be considered fleeing the seen if he doesnt report the accident to the insurance company or file a police report?

let me be clear:

HE HAS ALREADY COMMITTED THE CRIME OF FLEEING THE SCENE OF AN ACCIDENT.

However, if he reports it to the insurance company, if the other guys try to **** him, he would be in a better stance, still not a GOOD stance, but a better stance. Since for any accident you're in YOU NEED A POLICE REPORT. Am I clear?

If he exchanged info with the ppl on the scene, THEY'LL call their ins co and their ins co will call HIS ins co. Either way, his ins co will find out.

Tell him to quit being a weasel.

I've been on there chatting with him, we've been trying to explain tort law and the fact that having no police report kind of screws any chances of keeping it off insurance. : )

Police show up for everything where I live, if theres damage police show up. Also, if you don't file a police report and you duck out of the insurance deal, they will charge you if you run. if the other person SAYS you ran, you'll get charged. : ( They generally don't charge anyone with anything unless its something above a fender bender, if you just report fender benders to the insurance and don't call the police, they don't care much either. I don't know what the statute is, or whether they're supposed to care about fender benders as well, but anything higher than minor damage and you need to call the police where I live. : )
