Day 3. No police report filed still. Called insurance company again. Looks like the only way im gettin comp for my car is if i was in the right. So it all depends on that report. Unless someone can tell me if hes automatically wrong 4 driving on a suspended license.

turbo_dreams im not selling the corners of course not lol. Even if i bought a civic id find some way to use them. lol jk.

First off I am sorry for the lose of you wheels. Second I hope you get the new coupe you want. and here you have already been answered.

1. He hit you behind the driver's door, which is usually considered to be rear-ending. The driver who is rear-ended is almost never at fault as the courts (at least in VA and NJ, where I've worked traffic) see it.

2. If he has a suspended license and is the driver in an accident, it's automatically considered to be that he is at fault, because he has no legal right to be behind the wheel.

oh crap thanz zee i missed that totally, thanx. Well to confrim what that person told me, i just got off the phone with my insurance and she also said since i was rear ended im not to be at fault. Also that i should be getting paid for my car, and the fact that this guy had his license suspended just adds to the whole story. So looks like im gettin PAID!

An update/addition of pics. My friend sent me the pics he took from the scene. I guess you guys get to see the kind of train system and visual of what happened.

This is the last support i passed before i began to turn left. Right where the open space is, is where the guy hit me and i spun around. As you can see the car passing in the middle and cars park on the outside.

Another shot of the space where it happend. Thats not where my car stopped i had to move it for traffic to pass. But that is the driveway i was turning to go into.

Damage shot

another

This is a shot facing south, opposite the direction i was going. You can see the steps going up to the station, Me and my friend were parked about around by the last support in the picture. So from there i started driving on the right of the supports all the way to the one from the previous shot, I was signaling all the way, so im sure the guy had enough time to see me.

And this is all shots of damage to his car.

And a shot of the accident spot behind the po po's. For those of you who have never seen a ny cop car, heres your chance. I made the left from the first support on the right hand of the pic.

bummer man. i know you have probably heard this by now, but you need to make sure you seat belts are in working order, or dont let people sit in those seats. you may be held partially at fault (for the injuries, not the accident by description) for not having the rear seat belts working.

think you can get her to sign a liability waiver asap?

I believe she CAN sue you, and if she is underage, her parents can sue you for her whether she like it or not

then again if she is underage her written waiver probably isn't enough to stand up in court

yea this thread is back from the dead. No harm intended, actually i was showing a friend of mine the story that happened because it turns out:

The owner of the Buick is suing me personally!!! for those who dont know the story its on the first page, so read b4 you comment. Im at complete loss right now... im not understanding how someone who's license was SUSPENDED and got into an accident can now sue the person whom they hit. Someone with legal backround or law enforcement backround or anyone that knows something please explain this to me...

Apparently... for being underinsured? Like my passengers tried suing my insurance and he filed a claim also, so my policy couldnt cover both claims, they didnt pay him anything. Now hes suing me personally. But i dont understand why he would do so, when his license was suspended, AND his daughter who is filing for "17000 bodily injury" ran off the scene!!!

Well as you were encouraged to do so in the beginning, GO GET A LAWYER. Most of the time you can pay them off with your winnings.

I think his passenger already did sue his insurance comapny, and then the ***hole in the buikc tried afterwards. The insurance company only paid out the first claim(his passenger) so the ***hole in the Buick got no money and decided to sue scuffedchukicoupe personally.

Pretty much what trouble said. I don't think I need a lawyer personally cause the insurance said they'd cover the issue if it ever arose, I am askin opinions from lawyers I know personally. I just don't understand this guys train of thought as to how he has a case.
