I would whoop somebodys @ZZ! There is no way I would have left Rambo in a school full of kids. Shame on him. Go to a real mechanic.

I know in Va that would most likely be considered unauthorized use of a vehicle.

He put his car in the trust of the school. I would think the school would take all the blame. I guess the school could go after the family of the kid. If it was my child (they would have known better) I wouldn't pay a dime. Keys should have been locked up and only certain people authorized to "test drive".

That is Lawyer Becki's personal opinion. :biggrin:

That kid should be on the hook, but NJ has some strange laws.

There is no specific law in your strange little state. I would sue the proverbial S out of the kid and to a lesser extent the school for poorly handling this situation. The kid stole the car, that is far beyond the scope of the limited liability waiver that you would typically sign.

Who gave this kid permission to drive the car? Obvisouly the teacher should be fired. And the kids parents pay for the car ontop of the transformer being replaced. These people need to grow up and assume responsibility. I HATE the school system. They wanna restrict everything but when its time to pay up, they wanna point fingers back, just like little kids.

Education officials are ignorant. All of them.

First off, a Impala SS is nowhere near a performance vehicle.

Now, in most cases, if you allow someone to drive your car and they wreck it then your insurance company is on the hook for the car and the damage. The person driving, nor their insurance (other than possibly some form of secondary liability) is responsible. Thus, NEVER let anyone else drive your car....or....always drive someone else's car, with their permission, and you will never be at fault (which I find retarded...but it's how the insurance industry is setup)

In this particular case it would be interesting to see if the waiver he signed allowed for the school to take random road tests of said vehicle. If so, then by extension of that waiver, the owner of the car would most certainly be held liable for damages.
