Thought I should update the forum on this thread:
As of to date, I have received $205 dollars TOTAL repayment from about 2,600 owed and dictated to be paid back by the courts. I'm not a lawyer, but from what I understand, the damage done was enough for the crime to be considered a felony, if I'm not mistaken, but our attorney suggested we work out a deal where the four got 1-year probation with the terms of that probation being full payback of what was owed, at the rate of 100 dollars a month. I last received a check for about 35 dollars. I believe that once the money is payed, the record gets removed. The other choice was try to convict and simply forget any hopes of repayment.
So, none of that actually happened. No weekly payments were made from any of them. One guy said once he got his GED, he would get a job and pay the money back...who we kidding.
So, although the terms of the probation was to pay the money back, none of them were sent back to jail for failure to pay. I could have taken them all to court, but the cost of doing that, via small claims court, financially didn't make sense. It would have costs more than what is owed from what a lawyer friend explained to me.
So, the four bandits pay money to the courts. The courts store the money until such time as a normal distribution period occurs. They probably profit off the interest because they don't send money out as soon as they get it. At this time, the money is divided and sent out to each victim.
I can call to see how much money is in the pot, but can not initiate a payment or go to collect.
There were four cars hit that night. Only two of the owners showed up to court. The four criminals shared the burden of paying back the cost of the damage to all four owners. With only one of them working at all, the prospects of full repayment is really slim to none and Slim left the building. If one failed to pay, the others were responsible for that share of the cost. I found that interesting.
Funny thing about court: The wanna be thugs and their families get to sit right in the same room with you. A couple times, they sat behind me or across. They know who you are. You know who they are and where they live. They get your names. You have their names. I found that interesting. I especially liked the fact that, sometimes, we arrived at court the same time or sat outside together before the room opened. Them and their families were trying to grit on the victims. We call that mean-muggn in the hood lol. So, walking by them in the halls or in court, well, kinda interesting. Maybe that is why only two owners showed up.
I went to court on at least 5 different occasions. Some where delays. Most had me sit about 5 hours before being sent back home.
There were four young boys arrested that night, not just one. Their estimated ages were between 19-24. One worked in a mall. The other three were unemployed. One was working on his GED. None lived in the neighborhood. Their living arrangements were tentative. The majority lived with their mothers.
Three were locked up and stayed in jail for 7 months or so. The time varied by criminal. The last court meeting was a year ago...this thing has dragged on for years as they could not locate the last guy, who failed to show up for his court date. Each one of the four had separate trials. One guy was let out after about 5 months. His lawyers claimed due process...took so long to have a trial that they were in jail longer than what their sentence would have been. He agreed to pay, so they let him out that day. He asked to apologize and all I could do was stare back. As a provision, he promised not to return to the area. He's been back though. He must have some friends in that neighborhood.
Cool thing: When a court session is over, they call all the witnesses by name (damn, thanks dude), have you meet with the attorney for a quick sec. Then they give you a couple minutes head start on the newly-released prisoner and his sad-azz family...lol. I found that interesting.
Three of the four had pretty illustrious records of petty stupidity. The one who worked in the mall -- this was his first offense. I envision him trying to pay off all monies due while the rest probably don't give a damn. Why would you if you don't have a job, don't want a job, don't have an education. Why worry about your record?
My insurance paid for a brand spanking new Z3 (an upgrade from the Z2). No one pays for time off work or the use of vacation days to attend court sessions. Sold it to my brother for 800. He loves it.
I still have the Z2. It's broke down of course. One day, I might send it in for repairs. Pioneer estimated it would cost about 250 to repair it.
I decided to stick with the factory setup. All this BS just killed my enthusiasm for nav systems and low budget factor alarm systems. The original radio and CD system was reinstalled and I left it like that.
Picked up an iPhone and use the ATT Navigation on it instead. A lot less to worry about at night.
So, there you have it folks.
