Xterra Front Driveshaft Failure

Now my story: I have an '08 SE XterraI have been getting some vibrations in the truck with driving/coasting over the past 2 days, but didn't have time to get it checked out.I hit a small pothole going 15 mph and my front driveshaft connection to my front diff breaks. 3 of the 4 bolts sheared off and supposedly the driveshaft is bent (per nissan).

They said it was damaged during the pothole hit and won't cover under warranty. They claim the slip yoke broke causing everything to seize up and shear. According the that above link, Dana has some faulty driveshafts. Can anyone provide some insight to this? I'm afraid I'm going to have to pay the $500 for the new driveshaft and installation. This may affect Frontiers and Titans as well.

I'd make the argument that had the bolts not fallen off, the driveshaft wouldn't have gotten damaged. Perhaps add in an example like, if the brakes failed and I crashed as a result, would Nissan not be responsible? Or if a part failed and caused a fire, would Nissan not be responsible for the Fire?

If they fail to pay it then and depending on the actual costs and the amount of your deductible on your insurance policy, you might try submitting a claim. The mechanical failure would not be covered, but the ensuing damage should be. If the amount the insurance covers exceeds your deductible, your carrier will try and subrogate (though for a smaller amount they may not try as hard). In any case, if your carrier is successful at recovery and if they can get your portion (the deductible) then it would be reimbursed to you.

Your last option would likely be to file in small claims. It would be dumb for Nissan to let it get to that point, (attorney involvement on a case like this would probably exceed the damage amount) and I can't see a small claims judge siding with Nissan on this based on the reasoning for denials provided and facts you provided. I would try and get a denial with reasons for it in writing. Make sure Nissan Corporate is denying the warranty. A dealer would likely charge you the normal cost of repairs rather than the warranty rate they would get. So I wouldn't put it past them to see if you'ld pay it. You really have nothing to lose by "calling a bluff".
