I don't know their school rules, but I do know that high schools around here, teacher don't even have the power to take the cell phone let alone kick a kid out of class. The rules here state that the teacher is 100% responsible for all children that attend the class for the duration of the class. This means you can only kick a kid out of class if you know they are under another supervision. When I was in school you were thrown out of class, missed the lesson, don't know the homework that was assigned, got docked marks and it made you fail and repeat.
I agree that kids don't need the phones during school either and they should be stuck in lockers on silent, but since these are not the rules and the kid wasn't really doing anything, so I think the teacher made the first mistake by even making it an issue.
