Wow, I was NOT expecting that kind of response in less than a day! Thank you all so much for your replies. In answer to some of your questions:California and my home state of Washington are both "no fault divorce" states, which means that her actions play no part whatsoever in the divorce proceedings. As much as I would like to, she is unsueable on those grounds. I can only petition for divorce and hope for the best. I filed in Washington and server her with divorce papers stating that she willassume responsibility for those debts she caused on my behalf, as well as a denial of spousal support or alimony. She filed in California and served mea few weeks after I served her. Washington and California courts are debating on who hasjurisdiction and I am waiting on their answer. Given that we were married in Washington, we were both living in Washington originally, I'm still a Washington resident, and she was until she moved down here, as well as Californias financial troubles (she filed for unemployment, so the state is picking up her court costs), I'm hoping for Washington to take it all. If it goes to California, I have an uphill battle, as they will most likely award her spousalsupport (roughly a $24k-$30k lump sum), as well as a portion of myretirement checks, and a chunk of my retirement fund. Alimony is up in the airconsidering the shortness of the marriage (we were married just under a year before I deployed, just over a year before seperation according to her paperwork). As to the money she spent, in both states she was legally entitled to it. We had joint accounts and she had power of attorney, so I can't go after her for that. As to my belongings, I would have to prove that she stole them, which is pretty much impossible. My cats are doing much better. I've switched their diets to all natural foods, had them on antibiotics as well as herbal remedies. They both had horrible lung infections, fleas (and enemia from related blood loss), heart worms and tapeworms. Both of their coats have grown back in, they are clear of worms, fleas, and germs, and are adjusting well to the new place. I'm still furious at the condition they were in, but happy they survived. The only thing I can really do is batten down the hatches and brace myself for further rough times ahead. As to the car: I've replaced the headlights with black chrome and H4 bulbs, and I'vecovered the interior with baking soda to help get rid of the cigarettes and sex smell. She had taken the liberty of removing the oil pan drain plug, so I replaced the plug and the fluids. I added some RESTORE and that seems to be helping the compression somewhat, although it might just be the placebo effect. A bit of duct tape around the sunroof stopped the leaks, and I've got myiPod and headphones for music. I still have to bundle up in the mornings because it's frigging cold (heater was removed) but I can manage. Again, once I get a camera, I'll post pics.Oh, an I managed to pull 3 large garbage bags of trash out of it, including condoms and wrappers, empty redbull cans, cigarette butts and boxes, a few randomsocks, one pair of panties, and a tacobell bag from severalmonths prior. It's looking better already. Thanks again for all your support! I'll keepeveryone posted.

Wow dude... Honestly, I would have reported the car stolen, and then torched it in her front lawn, probably rolling it into her house. Maybe left some of the used condoms around to frame whatever dude she was boning.

There's a special place in hell for that biotch.

Hopefully the fact that you acted first will give you some leverage. If the state awards her anything, I would be tempted to turn around and counter-sue her in civil court. You might have more flexibility with charges here than you would in divorce court.

Best of luck to you man. Keep us posted.

Man, remind me to never get married to an evil wench under Californian law or any other states that in the end may support the actions of any other woman like your soon-to-be ex-wife. Yikes, i'm hoping the it all goes well for you and the courts do not decide to screw over a service man in attempts to uphold the law for a cheating wench. best of luck man.

I'm not a religious person at all, but your time will come. Trust me, it might suck that's she's getting away with everything but I honestly believe she's going to hell. I'm beyond speechless and taking this in before making the decision to go into the Air Force is huge to me. I really don't even know what to say. Trust me you will bump into her one day and find her sitting on the ground apologizing for everything she's done and I hope you crap on her and smile while you do it. Literally.

That's crazy! I just got done watching it for the first time on Netflix as well.

To the original poster of this thread:

You have been given quite a bit of good advice but I would definately leave out the "Domestic Violence", "Destruction of Property", and the "Homicide" parts. That will only make things worse for you and I'm sure you know it would.

I am truly sorry that you had to go through that and I hope you get justice. I would sideline 240sx plans until your ex is a thing of the past. Just fix what needs fixing and save the goodies for when she's completely gone out of your life.

Thank you for serving our country!

Still don't see any reason why you can't go after her for animal abuse/cruelty. You have proof that you were out of town and that she was looking after them and obviously they were neglected purely out of spite to you. Don't you have receipts and vet bills to show the condition they were in? Did you take pics of them?? I'm sorry, but this is inexcusable in my opinion. She could be in jail just on this basis.

Post some pics of her and I'm sure a few others here will be more than happy to spread them around a bit on the internet in a not so flattering way.

Wait....how do you have sex in a 240? O_O anyway, from one miitary person to another, this is a f*cked up situation and happens more than people think. Technically you can get her for adultery as long as you have that list of the dudes she's been with (that is F*CKED up btw..who keeps lists of the people you screw?) AND since they are all in the service, they'll get burned too.

In situations like this, its best to take things easy and keep stuff as peaceful as can be..sort of like a calm before the storm kinda thing. I know a guy that was in my old unit that went through almost the same thing and he stayed with her ONLY because the paperwork took that long. When everything was all said and done, He got her for everything she owed and the funny part is that she knew of nothing...keep that in mind man.

Are you sure about the retirement thing? How does the USN compare to the USMC in that department? In the USMC, you have to be married for at LEAST 10 years before she's entitled to anything. You should talk to your units law office...idk what's its called in the Navy branch

Wow, I'm really sorry for all of this crap she's put you through... it goes without saying that you are much better off without her. My advice: get a good lawyer. All the crap she's done has got to count for something.

In the Army, we would have to be married for 10 years before the spouse has access to the pension. After 10 years, she's eligible for half of your pension for the rest of your life.

Do you have to be married to be together? No. I would have to run into some pretty f***ing amazing circumstances to get married at this point.

In any branch of the military, the requirement for pension to spouses is ten years. However, local and state law always takes precedence. In California, it's year for year AUTOMATIC unless specificLly waived. Even then, it takes ten years of marriage before DFAS steps in. California law entitles her to half of everything (including benefits) regardless of her conduct. As to the animal abuse charges, it's not worth the $3000 in lawyer fees for a long shot at Mayr getting her a $500 fine. Thanks again everybody for listening to me vent. I hope to be able to start the build soon.

I don't know about CA law, but Florida is pretty harsh. See below link for FL laws, and then check yours. I have (had) 5 cats, the oldest that was 19 years old; I had to put him down last month. I am an animal rights supporter, so I guess I would treat it differently than you. In my opinion, she has no rights.

Scotty, don't ge me wrong, I'm a huuuuuuuge animal right supporter. Unfortunately, my resources and local law makes it extremely counterproductive to pursue a lawsuit against her on animal cruelty charges. I would end up spending over 6 times the amount she can be fined, if she were fined at all. My cats are healthy and happy, that's all I can do for now.As to the car, some good points were made. Basic "keep it running" stuff is all I should do for now until I find out if she gets the car and the bill, just the car, or I end up with both.

This boggles my mind. It's no wonder that whole state is going to hell in a hand-basket.

Hey, if she gets re-married, would you still have to pay her? (She would have someone else to support her.) If not, maybe you should try to get her a date!

No he wouldn't have to pay her anymore. It's law, mother is going through the same thing. She's not going to remarry ever again, let alone even thinking of dating someone. So the payment my dbag father has to make, will have to keep making them. It also applies if she even moves in with someone I believe.

I tell you what, for the great injustice she has bestowed upon you. divorce and I go and seduce her and have her move in with me. After that, go Sparta on her a-- kick her down an infinite pit.

Unfortunately, the alimony goes for as long as the divorce papers say it goes on. If there are conditions (re-marriage, living with someone else, time) for the alimony to end, it will. In some cases its permenant. I don't think that will be the case here, since we were married a relatively short time, she's young (22, lots of earning potential), and she had her latest boyfriend living with her when I came back from Iraq.Im really hoping that Washington takes the case, because the papers I filed have her receiving nothing. I got a really nasty facebook tell-all message in lurid detail, and a demand that I just sign the papers and pay her "I'm a California resident now, and that means I get alimony. You'll never get away from me." Frigging psycho! I was up in Washington on leave around our second anniversary. Since we were supposed to be up there for that, I had arranged (quite some time ago) to have anniversary flowers delivered. Her parents got them a few hours before I showed up to say hi/bye. Her parents knew everything (her dad even requested the pics as proof because he couldn't believe his baby would do something like this), and they all came out and hugged me and cried. They are pretty pissed at her, understandably. Very traditional people, and they think I'm just the most "wonderful thing to happen to our daughter". She has about a month left to respond to the Washington case. If she does she either has to hire a lawyer to appear in court for her, or appear herself. Since she's in San Diego, trying to eke out a living as a "business manager" for her wedding photographer boyfriend (27 yo pothead living in a tiny apartment with no real job, 2 DUIs, suspended license, etc), I doubt she can afford either, especially since her folks will probably not help beyond letting her crash there if she shows up. Keep your fingers crossed, everyone.
