Weird brake problem?

Well I got my car back and I've been driving it around and I noticed a weird problem. When the car is in gear the ABS kicks in no matter how light I step on the brakes and it jerks the car from side to side. When it's not in gear, the brakes work fine. What the hell is going on? Any ideas??
