so after a long 3 months of wait....the car finally comes in. everything looked perfect. it was a 09 3.5 in white with black leather interior with the premium package. then i look at the transmission and its a CVT which was NOT what i asked for. we went over talking about the transmission liek 5 times making sure that im getting the 6spd before i signed anything.now they are trying to say that is what i ASKED for, which i NEVER did.i already paid my $1,000 down until the car arrives, and its nonrefundable.i told the manager that i dont want the car, so he brings words at me saying, "well, what am i supposed to do with the car then if you dont want it?" well f***, thats not my problem that they screwed up on it. i dont feel obligated to pay almost 30k for something that is not what i asked for. then he tells me, "the CVT is only like $10 more than the 6spd "the manager told me he would call me tomorrow around noon, but i think ima jus go over there instead dont know what the hell i should do...or what i COULD do.they could be a total a** and say, "either pay for the car and take it, or we can just keep your $1,000 and you can leave".

if dey keep it, its time to sue, lol get what u asked for man, dont let them push you around. Also make sure they dont drill holes in your front bumper

Well, on the signed contract when you put the 1k down. It should specify the type of transmission. All basic information like even a window sticker should have been on there correct?

Never sign anything till they have the car on the lot! If they dont have the car threaten to go else where.

When i wanted my silver on black they had to get a swap. They at first said could not be done then i threatened to go to a different dealer. 2 hours later they called and said the car is there.

i checked the paper again and i noticed they didnt write ANYTHING about what kind of transmission it would be in. which i guess is partially my fault?at the time they didnt have ANY A/C on the lot, so we ordered from factory.BUT, check this out. i wanted the VDC and tech package right, but i guess it doesnt come available for 6sp. they asked me what was more importaint to me, the navi or 6spd. i told them the 6spd. then later they called me again and told me i couldnt get the VDC because its not avaiable for the 6spd.

do you think thats enough evidence to support my facts that i DID NOT want to order a CVT? if i relaly wanted a CVT i would have picked one up in Boise, and they were selling the 3.5 for only 21K at that time.

oh and the dealer is Ron Sayer Nissan of Idaho Falls.

That guy is full of crap and you should try your hardest to get your money back and leave.

I went through a lot of dealership crap when I went hunting for my car. They didn't have what I was looking for but kept trying to make me get the "better" package or a different color. I told every one of those salesmen to save their crap for somebody else, I was out of there.I only met one salesman that I liked, and I bought from him.

They must refund your money. Its your word against theirs. Since there where no specifics on the contract, HOW, can they say you wanted something without proof? They screwed up. Not you. If they do not honor your 1000 dollars back you have 100% Legit case to sue the company! Also, if they represent Nissan, Go Head Quarters! They may own a dealership but they do represent Nissan as a whole.

How did you pay the deposit? Check? Credit? or Cash?

Check they cannot cash till you get your product since its a deposit or "Down" Credit you can refute since they did not give you what you are paying for. Cash, well then that when ya gotta pull out the guns and make it a public issue. If its one thing that can screw a dealership its bad publicity! If the locals don't like the, then they will shut down!

There is a number of ways you can go. Just don't take no as an answer.

Stupid question... but has it been cashed yet?

If not, put a stop payment on the check. My bank usually charges around 15 bucks for a stop payment, but a whole lot better than being out a grand.

What Nissan dealership out there doesn't have coupes on the lot? Everyone I've seen has at least a small row of them. Most a large row if not multiple rows.

The 08's weren't "prone" to the VDC/6mt/Navi rule - it's the 09's that had this introduced.

so i went back in the dealer today and it wasnt as horrible as i thought it would be. they actaully found me a white 6spd located all the way down SoCal......they said that it needs to be paid full first before taking that car anywhere.AND they were gonna charge me 1k to have one of there guys go down there and DRIVE it back up here, which is like 700-800 miles? so i was like, no, f*** that, you guys need to have it shipped here on one of those rails, whataver the hell they call them.but i still think that THEY should pay for the shipping for messing things up.this was the first car we were looking at 3 months back, before we decided to order from factory.

Truthfully, it might be worth it to take a trip to a larger town with a larger dealership. This one sounds like it will be problems for you, now and later on. And paying the car all up front? What kind of crazyness is that?

Not to mention they dragged their feet and i was ALREADY MAKING CAR PAYMENTS AND INSURANCE PAYMENTS BEFORE I HAD KEYS IN MY HAND!!!!!!!

you dont HAVE to sign or pay for s*** until that car is in your lot, if they dont want to do that, GO ELSEWARE!!!!! THIS DEALSHIP IS SHADY!!!! I would go somewhere else based solely on previous events, REGARDLESS of what they offered or told me. f*** them.

ya enough saidi give u my idea to get ur money back i had the same transmission problem with the first dealer and i paid 2k downso i said ''if u guys dont give me back my 2k, i will not go home and stay in this showroom forever and ever'' LOL just remember u talking with this face never smile at them or nodding head after whatever hell they said.so good luck ,
