Wanted four Versa factory aluminum wheels

1500 miles on my aluminum factory rims, had tire dealer put on new tires and they scratched every rim where the nuts are. They used an impact socket that was fat and paint is scratched around every lug nut hole. They are telling me they are willing to compesate me but not buy me four new rims. What should I do?

They damaged your property and they are responsible. How much Comp.? They need to make you whole. If they won't fix their mistake ask them who their insurance carrier is and follow up with a small claims action. Any body shop will be able to fix their MISTAKE. Do they have one or are they paying you to have this done?

Do you think a body shop repainting them would be fair? Do you think a body shop paint job would equal that of factory paint ?

They damaged your goods. You have a right to be made "whole". Since your wheels are used as in used because you drove it off the lot , don't expect new. Living in IA will mean your wheels will start getting crappy after the second or third snow/salt.

Even insurance companies and manufacturers of goods are only held to a "pre accident condition" clause, meaning they don't need to use brand new parts if the car wasn't brand new when the incident occured.

It's very common for shops or insurance companies to replace parts on your car with used parts from a junk yard or remanufactured ones from a supplier. They're allow to do it as long as your car was already used.

They did damage them so you're entitled to replacement. But I agree... don't settle for anything less than a replacement... just don't expect them to be new.

Just make sure the quality of the new is higher or equal to the quality of the old pre-accident. I don't think they are allowed to replace them with lower quality or grade wheels. So if you had alloys they shouldn't replace them with ones that take hub caps. This is just my understanding.

the fact that they didn't realize they were damaging the wheels after the first wheel was put on, and continued and damaged all four, is reason enough they should buy you four new wheels.

I would agree. Such gross negligence/incompetence should have a higher penalty associated with it. If you scratch/ding one, whatever, fix it, make it so that i don't notice. You damage them all... well you're an idiot and I feel entitled to a higher level of compensation.

Damaging one wheel is an understandable mistake. Doing it repeatedly shows that they don't care.
