Versa CVT problem need advice

I own a 2007 Versa with CVT; at 64000 miles I took it to a franchise to have the 60K checkup & transmission flush service. At 76000 miles I began having a problem; at interstate speeds the engine will suddenly rev by 4-800 rpm, then drop back and do it again in a couple of minutes. I took it to the Nissan Dealer, they say the wrong transmission fluid was used by the franchise. According to the franchise invoice they used DEX VI instead of CVT NS-2 which is specified. The dealer says the warrany is void; the franchise says they ordered the fluid from the dealer via VIN #, so neither wants to be responsible. I expect the franchise will loose since they did the work. Here is my technical problem. The dealer says that if they just replace the fluid with the right one, it MIGHT be ok. The transmission is slipping pretty bad, I think I need a new one, what are the chances that after 12000 miles with the wrong fluid there is no damage to the transmission? My concern is- if the dealer changes the fluid and it is ok for a few thousand miles then starts acting up again is it the dealer or the franchise that is responsible to fix it?

On a standard transmission, 12k with the wrong fluid is completely non-fatal, especially before 100k.

With a CVT, I'll let someone more knowledgeable chime in.

I'd demand a new transmission. Let Nissan's lawyers and the franchise's lawyers battle it out.

Sounds like a good plan, but demand a new transmission from whom? If franchise blames Nissan and Nissan blames franchise, and OP is beyond his powertrain warranty anyway (would have been 60K miles at most, probably), then OP can demand whatever he wants and they have the power to ignore him until lawyers get involved, in which case the suit will cost OP more than just ditching the Versa and buying a real car.

Actually, he's not. Nissan extended warranty coverage for CVTs to 10 years/100k miles. So he should be fine as far as warranty goes.

Ah, my bad.

If you the franchise accurately documented what oil they used, and Nissan is saying that's not the oil they should have used, then you go after the franchise. Otherwise, you call Nissan Consumer Affairs (800) 647-7265.

If DEX VI is Dexron VI like I think it is then they are bullshitting you. No Nissan that I kniw of has ever taken Dexron fluids, thats a GM thing. I'd lay into that shop. Sounds like they just used what they had lying around.

Yeah, definitely go after the shop. Any good tech would not have done that. Totally their responsibility. If you have any friends who are lawyers, you should get them to go down there and "rattle the cage" a little bit. Being as it's a franchise, it is probably going to be a little more difficult to get the proper compensation.

These CVTs are nice but crazy. If I remember correctly they use something like a belt on 2 pulleys that close in on each other to change the gear ratios. So there are no need for clutches. Regardless, I would take it back to the last person that did the work and get a lawyer. You wont get millions but you can get enough money to get your problem fixed and you will definetly ruin the reputation of that shop. That should be a lesson. When things are still under warranty (have your lawyer look at those papers before you put your signature on the paper) you should go back to the place of purchase to have work done. Also, I would get your lawyer to look at a copy of the warranty.

It's Sean if you're referring to me :) I poke in every once in a while to keep tabs on you guys. My comp won't connect to the internet so I can only get here on my phone. Its kind of annoying being on here with a phone even though its a nice new smart phone. Oh well.
