The President CAN present legislation, however, even if he can't vote on it.
The Supreme Court cannot introduce legislation.
I suspect that they're asserting that McCain voted "yes" on 90% of legislation introduced by the White House (i.e. budgets, the bailout, or whatever else, you see them propose stuff all the time).
EDIT:
To the original poster, McCain does, generally, vote with the party on most issues other than immigration, campaign finance reform and, sometimes, the environment.
He is not "McSame" per se, he is not George Bush, but he supports the same supply-side economics, he would appoint similar justices to the Supreme Court (i.e. pro-life), he has very similar foreign policy views, et cetera. I don't think McCain himself would refute any of this, as these are his public positions.
What issues are important to you? If you let us know, we can figure out which candidate most closely reflects them.
