Ugh, I hate this guy....

Ok, last week, I was in my mom's car (Accord) and I was taking it around to get some estimates for the front end damage and I was almost at my mom's office. I pull into the driveway and there was already this guy making a left onto the street I was making a left from. As I pull in, this foo punches the gas, tires screeching, and totally clips me as I'm going into the driveway! I already gave my statements to both our insurance companies, and HIS INSURANCE DENIED MY CLAIM COMPLETELY, because that idiot changed the story, knowing it was his fault, and said I clipped HIM by turning too much....UGH! So all I have is the pics of the damage which I'm sending to the insurance companies. I don't have any witnesses, all I have is his apologies to me (like 3 times) and the damage on the cars.

You guys have any advice on what to do? I'd appreciate it, because I know 100% that it was his fault but I'm not sure how to go about proving it.

It was on private property, which negates the necessity of a police report (you should have called the police anyway).

It goes on your insurance - And any damage to his car goes on his insurance.

If it's worth it, you could get an attorney and a certified accident investigator (like me!) but it'd cost you. The AI would be able to tell who hit who and who's at fault. Probably not worth it. Get it fixed on your insurance.

Ben, I was in my mom's car getting estimates for the front end which was damaged in another accident. (Ironic, huh?) I had just come back and I got hit.

Hitman, I sent pics of the damage to the insurance company, both mine and the other guy's....if I sent you some pics, would be able to tell who hit who? Cause I swear.....that guy is pissing me off so bad right now, ugh......

edit: Also, would that mean my insurance goes up and/or I get a point on my license?!

drifter - it'd be hard to tell from pics since they're 2-dimensional. Also, really need to see the roadway to measure grade, approach and departure angles. Need both cars present to measure spring deflection (at varying speeds), ride height (loaded) as well as tire scuffing, etc etc etc.

No points on your license, and if the damage is UNDER a certain $$$ amount, no insurance increase.

Maybe if the front end damage is being covered by insurance, you can get a real high estimate on the front end damage (try the dealer) then actually have the car fixed at a cheaper shop - They can repair the extra damage while they've got the car.

Repo and lessthanjakejohn, if I told you guys how many times I thought about what you guys are suggesting today, you wouldn't even believe me. As much as I want to do that, I don't wanna sink to his level. The really sad thing is that he goes to the private Christian university that my mom works at, and he LIED to the insurance company about the accident. I would slash his tires, and that does sound tempting....hmmmm maybe I will after all.....:)

That sounds like a really good idea, Hitman....thanks for helping me through this, you have some really good advice...I just wished I had gotten some witnesses names down if there were any, or somehow had something that proved it was his fault....sigh....

Hey ninja! Haha, how's it goin man? Yeah, I don't really have a lot of cash to spend on a lawyer right now...would be nice though, with Johnnie Cochran on my side! :) Anyhoo, we just sent the pics to insurance and hopefully they will have some kind of idea.The fact that they denied my claim completely was irrational...they didn't even study it very well obviously!
