Transmission Flush Issues

So i went with the Dealer recommended 60K schedule service which included replacing the transmission fluid (Service manager said they flush it)

This was 7,000 miles ago.

67000 miles on car now

I was reading the 2010 infiniti service manual and it says the 5 speed M35 should not have the fluid replacement at the 60k service.

The ride has been jerkier and sometimes the rpms hangs for a second or 2 during normal acceleration between 4th n 5th gear (like the car doesnt know whether to stay in gear or shift down around 3000rpm. There is no slipping going on at all.

seems like the car just doesnt know what to do sometimes.

If fault of dealer what angle do I have seeing as car is out of warranty.

Due to the mileage difference I don't think dealer will do anything for you. If you noticed it within 500 miles or even 1,000...would be a different story.

Is there enough fluid? You can try unplugging the battery over night and having the ECU and TCU clear their memory or what not (I know ECU will clear, not sure about TCU though but I'd assume it has a similar setup).

Transmission fluid level is critical....
If it were my car, I would have that checked (fluid level) and get a sample from the tech so you can send it to a lab for analysis.
It sucks that they did away with the charge tube...
