I know my opinion will be contrary to many, but having just traveled this very path as I now have 34K on my 07 M35X I feel qualified.
My dealer pushed hard to have the transmission flush and other maintenance done as under the SEVERE OPERATION service schedule it is required. My car is not operated under that scenario so I told the dealer no.
However, just to have a piece of mind I had my local shop test all of my fluids to see if in fact they warranted replacing. Guess what???? None of my fluids to include transmission, Differential, Brake, Power Steering, or Radiator needed replacing. They weren't even close!!! I'd have wasted my money to the tune of several hundred dollars if I had believed the stealership.
Save your money and wait at least until you hit 60K. If you are nervous, go to a shop you trust and have the tests done and then keep the records of the results to prove your position. Believe me, all shops want to do this work because the profit margin is substantial. If the testing shows you need the work - they will be happy to do it for you.
