Noone likes paying bills. Insurance is probably one of the most hated bills to pay. Especially for those who don't use it often. I'm sure there are people out there who have never filed a claim in their lives. I'm sure that leaves most of them with a bitter taste in their mouths. But keep in mind, you are paying not just for indemnification should a loss occur, but also peace of mind so you don't have to worry so much about what happens if a loss occurs. And it's not so much what you pay, but rather that you are contributing to a pool of money used to pay claims for all the people who contribute. I posted some statistics this month regarding fraud, which includes inflated claims. You can thank those who commit fraud for part of our rates.

A 17 year old is a high risk. Especially if it includes collision and comprehensive coverages on the vehicle he drives. Unfortunately, statistically a young driver is more likely to be involved in an accident. And that's not the insurance company's fault.

that 4500 will pay off quick when someone totals your car and its not your fault. thats what it's for. remember, all insurance companys have to go on is statistics, you may be an exeption but you alone doesnt make up for everyone else.

C-Kwik "Two wrongs don't make a right? " NISMDrift deserves compensation beyond replacement of the car. The only thing wrong is you don't think he should ask for any

"It's truly in the best interest of any insurance companies to make a fair, reasonable and timely settlement of any claim. "While this may in fact be true in theory... I have never seen it practiced. As an adjuster, how often do you offer to compensate when you are not asked to do so? Many people are simply intimidated by the claims process and accept whatever is offered to them. You don't get what you deserve. you get what you negotiate.

"I would hope all claims are handled fairly,..." maybe somewhere over the rainbow...

"I'm sure you'll make a really good businessperson"

I have been selfemployed for over 20 years. I probabbly earn the average adjusters annual salary every two weeks.. I have been driving since before you were born.

I make my living assessing risk and placing a dollar risk reward valuation on the business decisions I make everyday. I am intimately familiar with balancing risk ,loss, and reward over a group of opportunities as well as on an individual basis.

"There is no such thing as as having a freind in the insurance adjustment business."

I'll be sure to mention this to my friends. Oh wait, I must not have any.

You are right on this one... some of my best freinds are in the Ins business... so I am sure you too have freinds.

You sound like you are enthusiastic about your job and I am sure you do it well. However, having been on the other side of the negotiating table with insurance adjusters 4 times and never once been at fault I can assure that I have only seen adjusters try to deliver a slanted onesided win for their company.

I have one question for you. Is any part of your compenstaion tied to settling claims at the lowest point possible. I think that pretty much sums it up for how insuracnce adjusters really veiw claims

Fish, based on the adjustment I got when my s13 was totalled, I tend to think some adjusters a very if not more than fair. The accident was MY fault, totalled my car and damaged another, yet they still valued my car to be in "perfect" condition. They even took into account my new tires, stereo, exhaust, everything even though I had no reciept or anything. Yes it was my insurance company but I still that that was extremely fair. Too bad I couldn't afford to stay there once I had a bigger car payment for my new car.

C-Kwik wrote:This is about the most irresponsible post I've ever read. I work claims for a living. I have no problem with people getting compensated a fair and reasonable settlement. But in no way is anyone entitled to money just because they are involved in an accident. If an injury does not become apparent within a few days of an accident, chances are it probably never will. If there is no injury present at the time, you can choose not to claim anything, and if an injury arises later, then you can certainly claim it at that time. But it will be subject to credibility and your state's statute of limitations.

Keep in mind that generally, no medical liability releases are requested unless a payment for an injury claim will be made. And it is generally separate from the property damage claim which most companies do not request releases for(property damages are less subjective).

As far as the value of any injury claim, it is a case by case basis. You said it was worth $5K. I'm not sure if you were being sarcastic, but in any case, not everyone's injuries are the same, nor are everyone's ciircumstances the same. The same injury could be valued at different amounts for two different people. As an example, a scar on the face of a single person is worth more than on a married person. A person who has an injured right wrist would likely have a higher value if they are right hand dominant, rather than left hand dominant. There are a large number of factors to be considered. Injury settlements are never just as arbitrary as saying this type of injury is worth X amount of dollars.

And as victimless as you might think inflating or pursuing a false claim might be, it is not. We all as policyholders who pay premiums are the ones who actually pay for these claims. Insurance companies like any business need to try and make a profit. If they do not, there is no point to keeping the business open and if they are losing money, then it will go under. So if claims expenses and payments go up, so do premiums. Think about it.

I'm not expecting you to know all this, but try to think about the big picture when posting.

So you work claims huh? What does that mean? you get the $11/an hr job answering the phones when people like me call? You didnt say claims adjuster. And yes, you are reading a company line, and making a company bias remark.

Now pardon my lazyness C-Kwik... I was in a car accident monday nite, totaled my 240, i am stiff and sore, and my back is killing me. I really didnt feel like sitting here at my computer in this crappy chair for an hour, writing an detailed 3000 word essay on how it went down, just so you understood what my case is here. The things is i dont have to. I came to the boards to tell my fellow NICO bros how i totaled my baby.

Just so C-Kwik can rest at nite, and stay off my "irresponsible" thread... Listen up. I am 23, not 17. This is the 5th accident i have been involved in, not my first. I am not a dirtbag, sleaze ball, or faking anything. I have given explicit details to my ins. co., their ins. co., and my lawyer. My lawyer is actually my general managers personal, and my dealerships own lawyer. He popped up and gave me advice, and said hed help me out if i get pushed around my the ins co. Hes actually feared by every ins. co. in oregon and washington here... I think he knows what hes talking about.

Oh, and C-Kwick, again... The guy made a blind left hand turn on a highway, I hit him doing 40-45 mph, and in about 20 minutes here (as soon as i resize them) Ill have posted the pics of my car. I dont need your opinion on how to go about anything, or what case i have or dont have. Make you own judgement, but keep it to yourself, and stay out of my thread!

No, that is not what I said. He should be compensated for his damages and injuries, if any. BUT, if he had no injuries, I would say it's not right to claim that. Your post implied that someone should claim injuries despite not feeling any pain. That is irresponsible. Claims are generally settled based on actual damages. Future losses should only be considered it there is an actual injury. Statute of limitations can run out, before treatment is completed, so in cases like that it may be appropriate to do so. But it is not paid based on speculation of futures with no injury at the time.

I too am a consumer as well as an adjuster. I've been on both sides of the table. Even before I was an adjuster. Every one of my claims went smoothly and I got a fair an equitable settlement. And in fact with two of my claims, my own carrier overpaid the other party's claims. I'm sorry to hear of your bad experiences, but with 4 bad experiences it makes me wonder if you might have unrealistic expectations. I've handled thousands of claims and most of my claims do not have disagreements as to the value. The ones that do, I explain how we get our numbers, and explain different ways they can look into obtaining their own value(particularly on total loss claims). And when they do the research they more often than not find that our numbers are pretty good.

And any negotiation is based on what an insurance company is willing to pay and what a claimant is willing to accept. There will certainly be times where there are differences that can not be resolved. Insurance companies are more than willing to consider alternative dispute resolutions. And ultimately, if it can not be resolved it is up to the courts to decide. As I've said before, if insurance companies did all the things you say as a general way of handling claims, then we'd see a lot more cases in court.

This response was never directed at you. I said it was an irresponsible post, not thread. Notice who I quoted. And do you really think my post in this board is going to have a great affect on my job or my results?

And to clarify, I am an auto claims adjuster. I've handled thousands of claims. I've was asked to participate as a trainer in a 9 week long program where I trained claim staff from our offices across the nation. I'd like to think I have some kind of idea of what I am talking about. You can decide that for yourself though. I'm not looking for your affirmation.

I never said you should get nothing. I was never very specific about what you should get, but I did comment on a couple of things that were not something you should expect to get and the reasoning behind it.

I never asked for your age and personally, it's not relevant. I don't use the argument of age in my claims, I certainly am not going to here.

That's fine that you have an attorney to help you. But realistically, it's doubtful he is feared. Most attorneys who deal with insurance companies tend to have a good rapport with them. And believe me, attorneys are nothing to fear. They are just as human as anyone else. Most adjusters will have handled more claims in the same time period as an attorney will have. Adjusters have to know and understand the same laws the attorneys do. Who knows, he might be good at his job. But feared? Doubtful. A pain to deal with. Perhaps. But I do tend to find it easier to work with attorneys. They tend to have a better understanding of what is reasonable and since they are not personally attached to the claim, they can see it more objectively. And if you want to see the flipside of what flyfishz says claims insurance companies pay out, you should see some of the things attorneys include in their demands. They know it's not reasonable or even common practice to pay what they ask for, but they will pose the argument anyways. And generally, they drop those issues right away when they are questioned about it.

You can certainly choose to use any information I provide or not. But this is not YOUR forum. If I see an opportunity where I can help, or if I see something I disagree with, I will say something. I've said nothing hurtful, distasteful or hateful. As long as I am posting within the guidelines set forth by the NICO admisnitrators, it is my choice to do so. As it is your choice to rear or disregard my post.

But again, my original post that you responded to was not directed at you at all. The post after it was and I really said nothing in that one that should provoke such a defensive remark. I never questioned who was at fault. You never asked for an opinion on that and I am not handling your claim, so I am going to take your word for it.

Naw, its all good.

McLoughlin/HWY 99E right where it meets with HWY 224 between milwaukie and portland. Youre from portland too, so you might know where the old southgate movie theater was. It was right at that intersection.

And its red. But either an old red, or weird lighting, cause yea it looks orangy.

I get stiff and sore when I jog a mile...you'll heal ;) As for the back...99% chance it's just strained a little from your upper body pulling upwards and forwards on it, give it a week and I bet you'll feel good as new :D I wish people wouldn't always jump to the "I'm hurt" conclusion the first instant they feel pain. I went snowboarding with a girl who fell and then said her neck hurt, I'm like no **** sherlock, you fell...get up and snowboard it off. But no, I had to spend 45 freezing minutes helping get her onto a backboard just so she could get down and find out wow...she was totally fine. Then I had to listen to her ***** for 3 more days about how much she hurt...bah, I get frustrated with whiney people. I'm sorry for your automotive loss, but I think you'll be just fine physically. I had a friend hit a semi in a front collision at 130mph...sure he broke his femur in like 3 places...but his back, neck etc. is still fine :D

Hehe, yeah...I can be sympathetic about most things except physical pain. My girlfriend thinks I just have a high pain tolerance because she sure as hell doesn't. When I totalled my Blazer, everyone but me was sore and two of em' went to the hospital. Of course, everyone was fine yet again ;) I was fine because I ducked, I KNEW it was going over. Good thing too, roof ended up where my head should have been.

Damn thats a sad end to a beautiful car :( sorry about your loss man but you know this just means another project ;)

Hijacking: My dad's 1998 Cavalier got destroyed by an SUV a few years ago. My dad pinched a nerve in his back but was over it in a few weeks or so. Furhtermore, the driver of the SUV was uninsured, and had only paid the $300 fee for uninsured motorist for virginia so thats all he got, $300. She ended up paying for the car and the med bills as well out of good faith though.
