To sue, or not to sue?

Yeah, i'm just going to get it replaced and let life go on. Not that big a deal in the long run..

And AZ gives me a permit at 15 and 7month and I have a number of 18+ friends who are happy to ride in the front seat and facilitate my driving, but my license isn't that far off so eh.

and I don't demand respect from anyone, while my actions on the compu-machine are not very telling to what I am like IRL, or anyone for that matter usually, but I ususally earn the respect of others, i've always been a year or 2 younger than everyone I roll with, and they've been fine with it because while I may be 15, I don't generally have the immature dumb **** attitude of a 15 year old... but sometimes it slips out :P

sorry to be sorta off topic but if a buyer cancels a check for about 300 dollars.. but paid majority of the car in cash. Would the the seller be able to take it to smallclaims and win? Given the car had many problems when I bought it, broke down when i was 1 block from the freeway onramp =[ . How much are small claims court anyways. thanks. Sorry to be off.

Hmmm. Not a very good chance the seller would win. Once the seller endorses the title and hands it to the buyer, the deal is completed. Rule 1 for a seller is to never ever accept a personal check as payment for a car because the check could easily be cancelled or bounce. If a seller does accept a personal check, he/she should always hold the title until the check clears. No buyer should argue about that. Cash or certified funds are the safest way. FYI $300 is not a very big number to go to court over when you add in the time/hassle involved chasing it.

thanks bubba for the information. Ahh it really sucks how I have to be the bad guy on this whole deal for my car. I really dont want to be. grrr. But the guy lied about the leaky injectors..and i didnt know that if it leaks it can cause fires...my life at risk there.

Anyways for the threadstarter.. i dont think you can sue them since like everyone said, it is a used car. unless you had wrote them a check ;) hahah ok kidding. But yeah, they probably can say you shift bad and messed it up.

300 Bucks for a clutch isn't anything to bad. I just bought my 240 from a fairly well known 240 member. I assumed that he knew what he was talking about when he was telling me this and that was "fine"when I SPECIFICALLY asked him to list ALL the problems. After I bought the car and had it inspected.. here's a list of problems.

1. Ball joints on all 4 corners need replacing. ( he said suspnesion is fine )2. Rear control arm is broken ( again, no mention )3. 3 out of 4 injectors leaking ( I smelled fuel on the test drive, he said it wasn't this car, it must have been another car )4. Left head light was shaking, I asked what was wrong, he said " flip lights do that". Found out it was being held up by a poorly made bracket.5. Asked him SPECIFICALLY if the car had ANY rust ( besides spoiler mounts ). He said no, inspection says I have frame-rail rust bad enough to fail inspection.6. Asked him what kind of gas mileage he gets, he said 25-30mpg. I've been keeping track for 3 tanks now, I average 10-15mpg, again, straight lie.7. I SPECIFICALLY asked him " WILL THIS CAR PASS INSPECTION ???" He answers affirmatively. "there's no reason why it shouldn't pass"

After the inspection, the rough estimate to get the car into passing shape was 1,800 to 2,000. This is for a car I paid 2,300 for. And please keep in mind I knowingly paid 500 over market value for the car based on the sellers word that the car was immaculate.

Now I will give him the benefit of the doubt, and assume that he did not know of all these problems. HOWEVER, since I did specifically ask him about these issues beforehand, I believe it was completely irresponsible of him to give any kind of affirmative answer. He should have just said " I don't know".

I am taking care of all these issues, and the car is fine and will be on its way to be more then fine. It passed inspection and I have it on the road.

Point is, Yes you got screwed over probably. Used cars have a funny way of breaking down all at once very soon after someone sells it. I undoubtedly got screwed over paying 500 over market value for a car that needed 1,800+ worth in repairs. And yes, these people are dishonest, and don't deserve to breathe the same air as me. But in the end, it was our carelessness to blame. You got to cover your *** in situations like these. I didn't , and I got screwed over well worse then you. I learned my lesson, always do state inspection before purchase. And you obviously learned yours.

I feel your pain, but all will be fine in the end.

HEY LITTLE BRATTY BOY THAT NEEDS BENT OVER DADDYS KNEE FOR TEARING UP A CAR THAT HIS PARENTS JUST BOUGHT HIMIt truely makes me sick to my stomache to think that my son is growing up with a generation that instinctively thinks of sueing at the first sign of somthing going wrong,rather than taking responsibility for their actions and trying to remedy the situation it seems so much easier to put the blame on someone else and try to force them to fix ones' own mistakes.It truely is a sign of the times that we live in.

P.S. toki,if you can take it in stride then it shows that you are probably a pretty cool kid,but if you let it bother you then it just reinforces the statements above

I didn't read this topic at all but here is my two cents. You where put on this earth to live, make money, pay taxs, and die. Along this magic carpet ride you have the right to atleast sue two or three people, sleep with one superstar, and say "HEY, thats me!" in a magazine.

I say sue!
