I would try to get them to repair your car under the emmissions warranty which is 80,000 miles. Seems like you missed getting it covered by your regular warranty by 2000 miles.

What are they charging you, 2 hours labor? That's insane, I work for a dealership (in warranty), and I know that it doesn't take over an hour to refalsh an ECU; .7-.8 hr maximum. I'd try calling another dealership, and see if you can get done for .5-1 hr labor.
