Strange behavior in first gear...

So I've had my car almost 2 months now (m56) and I've recently noticed the car behaves oddly in 1st gear, ESPECIALLY when I give it more gas then during my normal driving. It's almost like it hesitates where RPM's are rising and then will drop about 300-500RPM then surge back up.

I've heard people talk about hesitation but this seems different then others explain? Under normal driving conditions I never really noticed it but now that I've driven it a while and really noticed it when stepping on the gas a bit, I seem to notice it all the time now. I went to my mechanic and we drove it around with his computer hooked up and got the codes shown below - none of which seem to have anything to do with the problem described, nor any codes I'm having much luck finding any info on!!!

Anyone have any ideas short of taking it to the stealership? YES - no warranty...

I've had weird issues...I've had issues where it seems the car is upshifting WAY too early so even though I'm doing like 30mph I'm already in 5th or 6th. When you give it gas, it doesn't seem to want to downshift right away so the whole car bogs down. It happens randomly (happened today) and then doesn't happen again for a while.

This is the only downside of this car. My M35x never did this. The TCM or ECU in this car is a POS.

I've also encountered these issues in my M37 with car shifting too early at times. When this occurs it seems the shifting is a little jumpy (not the smoothest). Ended up getting the transmission service done a couple of months ago but it still happens. On a side note the car also did this before I Uprev'd.
