Shift Control assembly replacement for 2008 Rogue

2008 Rogue won't shift out of park. The shift control assembly needs to be replaced. I've read in the forum blog that some dealers view this as covered under the powertrain warranty. My dealer will not cover it. I have a call into Nissan corporate. What's the story? Why do some dealers cover this and others not?
