Rear seat won't lock upright

So after laying the rear seats down in my wife's new (to us) 2005 Murano SL AWD, the driver's side rear seat won't lock upright...the passenger's side locks up and stays, but the other side won't...any ideas?

Could it be that somehow the seat latch is already in the locked position?

You may want to try pressing the unlock button for that seat and see if that sets the latch back into the unlocked position.
