Rear End Accident in my 2012 Coupe

I just had bought a new 2012 (uncle works for Nissan and was able to still find me a new 12 and an amazing price) three months ago and yesterday on the interstate a guy rear ended me into another car. My altima sustained some heavy damage. The back was smashed in pretty bad (lights fell out place, trunk gone, bumper destroyed), the front isn't as bad but it did dent the hood badly and the driver door now cannot be fully opened. While the car still started, btw the accident was of course ruled the other guys fault, I refused to drive it in that condition and had a truck come and get it. I'm really hoping it's declared a totaled loss because I have GAP coverage. What has been everyone else's experience? If they try to repair it I'm going to file suit for loss of expected value agaisnt the individual that hit me and his insurance company since it is a brand new car.

from the sound of things, it should be considered a total loss. BUT in any case if they don't declare the vehicle as a total loss, you argue with the insurance company and tell them to declare it a total loss. Most of the time they will in the end make it a total loss just because they want to save all the hassle. Keep in mind your insurance will go up regardless if it's the other persons fault or yours.

It also depends on the mileage of the car. Can't declare it a total loss if the damage is less than the cars value

With damage like that it should be considered way below value, a 2012 altima coupe 2.5 in black book is approximately worth 13k with under 28k miles. The depreciation on these cars are ridiculous :(

How did you get access to the Black Book valuation? Do you work for a dealership?
