After all the 5.1 talk, I was torn but ended up deciding I would rather spend the little extra on a larger engine than the 5.1. I got a M45 that is not the sport package, but has the upgraded sport wheels with NAV, rear view monitor, heated cooled seats, silver/black, etc. It has 14k miles and I got it for 29k. I should pick it up Thursday and I am excited to drive it. I will have to hope for not a lot of snow this year with the rear wheel drive, but I will enjoy it the 360 days out of the year that it doesn't snow.

Nice looking car! Either they upgraded the pedals and trimmed the seats to look like a sports, but I'm pretty sure it's a sport package original. Are the front headlights darkened too?

To confirm it is an original sports package, does the RAS light come on when ignition is in ON position?

It would be more expensive to upgrade to sport options to the point of changing the steering wheel and pedals instead of buying the sport version to begin with.

The front headlights are darkened. I see the sport wheels, piping in the seats and such that the sports package has, but I thought ALL sport models had the titanimium/aluminun trim and not the wood or am I mistaken? Can you get the sport in wood? All the better if it is the sport package, but I just want to make sure it wasn't pieced together.

aluminum trim is standard on the sport models, but wood is an available option.

The orange stitching on the steering wheel is indicative of a sport model.

It sickens me to write this, but I've had my car in the local infiniti service here in St. Louis to get several glitches ironed out after my purchase. (check engine light, TPM, NAV glitch) I got a call today from the service advisor that made my heart drop. His tech is telling him that my car had been in an accident before and they have to decide if it will be even covered because any damage caused by an accident voids warrranty.

I am furious because the dealership that I bought this from which I will not name at this point (still waiting to see what they will do) ASSURED me that this vehicle had NO PAINTWORK NO ACCIDENTS of any kind. Through some research of my own today and blind luck, I managed to track down the previous owner and he said that it had been in two accidents, one of which was pretty major that the front end was buckled in like an accordion from hitting a parked car at a high rate of speed. He said it was never the same after that which is why he traded it in.

This was not disclosed to me and I want to know what I can do. I asked at least 5 times before I purchased it if it was in any accidents or had any paintwork. The dealer I bought it from said they bought it from Infiniti at an auction and all of that would have been disclosed if there was damage so I need not worry.

At the very least, they need to send a truck to pick this car up and give me my money back. I can't afford the time and money to drive the 3 hours to the dealer, rent cars, etc. I would think that they could get in big trouble for activities like this. Any advice?

I hate this because not only do I have a bum car that is not fully covered under warranty now, but I don't have anthing to replace it. It took me some time to find this one and I can't afford to wait weeks to find another car and that is if the dealer doesn't try to screw with me.

Oh that is horrible news. That car looked great for being in such a wreck. I almost missed frame damage on a m35 but luckily started using autocheck.com instead of carfax.com.

The autocheck report I've seen clearly shows that the Auction reported frame damage and if your's had similar notation, then you really have some ammo against the dealer.

If you want to email me your VIN i'll check for you? Hopefully that doesn't come across as sounding shady. Keep us posted to your outcome.

I'll email u a screen shot but it clearly states there was an accident on 9/2/07 in NY. That should help you in clearly showing the dealer they lied to you.

I saw that today because Infiniti service here in St. Louis pulled the carfax on it for me. I always run carfax before but this time I did not because they told me it was owned by Infiniti as a lease return and was clear. The dealership didn't have carfax available to them and I knew that prior damage had to be disclosed on all auctions so I thought I was safe. This makes me sick. I am supposed to talk with the dealership tomorrow. The salesguy was very agreeable with me and apologetic (acting like they would absolutely work with me on this) but salespeople tend to just say what we want to hear so we will have to see once I talk with the manager.

One always obtains the dealer performed service history and a CarFax report prior to the Infiniti Senior Technician pre-purchase inspection.

Not that I want to bail on you all, but the dealer has been extremely honorable during this whole situation and has actaully worked with me to get a better deal on a different car. The M45 supply was limited over the last month, but I ended up getting a Mercedes CLS500. Due to my problems, the dealer actually gave me full trade in value on the Infiniti and gave me the new car at his cost from the auction. It is actually a much better deal and this crappy situation turned out to be a good one in the end. This is the first time in my life that I didn't do the carfax report and it came back to bite me, but at least I did research BBB and reviews to find a dealer with good ethical and business practices. Thanks for all of your help.

Since I will not have the M anymore and I already bought a 7.3 NAV disc and a complete set of owners manuals with leather folder, I will have to sell those to anyone interested. I appreciate all of your help and advice during this stressful situation. Maybe my next car will be a M again. This is actually the second time I was going to get an M and for one reason or another, I got something else at the last minute. Thanks

Glad to hear that the dealer did take care of you. The CLS is a great car, looks alone are to die for (subjective).

I hope that the one you got will be trouble free, since a lot of the E-class and CLS' have been nothing by nightmares. Which year did you end up buying? 2006? Make sure to get M-B extended warranty, as anything that will go wrong will be crazy expensive to fix.

I don't think a car dealer can hide behind the, "as-is" in a case like yours. You should at least call an attorney, and talk. Even if you have to pay for an hour at the lawyers office, it is still worth finding out if you have a case, or not?

No need at this point...the dealer bent over backwards for me to make it right. I think it was a honest mistake in that he sells too many cars and didn't take the time to inspect it like he should have. I got a much better deal in the process. What damages could I claim when I got a car that is worth much more than I paid.

To answer the other response, I will get an extended warranty. I know German repairs are expensive.

Triton truck design 3 valve SOHC V8 is not one of their great engines either.

At least you got out of the rebuilt M45.
