I started the process of trying to get money from the town once when I hit a pothole in the rain and trashed two brand new tires (which happened to be AVID TRZ's, actually). Unfortunately, I never followed through.
I was driving home with my wife from a charity function on a rainy Friday night. I was in the right lane of a two lane road. I didn't see the pothole until I hit it. It was a new pothole that caught me completely off guard. It appeared to be a rectangular hole cut in the pavement. The very next day an orange construction barrel was placed next the pothole and an orange traffic cone was placed inside the hole.
The tires didn't rupture, but had significant sidewall damage. When I brought my car in for service and a tire rotation a week or so later I was told that the tires should be replaced due to the sidewall damage and potential for a highway blowout.
I made a few calls to the town hall and found the person that I needed to talk to. He indicated that I need to write a letter explaining what happened and where and that I needed confirmation from the garage that the tires needed to be replaced. He said that the town investigates whether or not any road construction projects were active in that area (because the hole was rectangular and possibly man made). If any projects were active, the town would make the construction company pay for the tires. Otherwise, the town would review my case. The town sets aside money annually to pay for pothole damage.
You need to try calling the local town hall (where the pothole resides) and determining the process for filing a claim. Get a note from the garage that sidewall damage was noticed on the tires, likely from a pothole. Then make sure you follow-through!
