Wait, correct me if I'm wrong, but these guys were making non-serialized AR lower receivers without a license to manufacture firearms, right? In the case of an AR15 the lower receiver is the "gun" plastic or not so I don't see how they have much of a case against the ATF.

The point is that under the law as its written they were not making AR lowers.
The law does not consider 80% lowers "Firearms".

no. the fire control group needs to be milled out. they were selling hunks of metal, that LOOKED like ar lowers. thats it. the law allows you to take that hunk of metal, that looks like an ar lower, and mill it out so that it functions just like an actual ar lower. you can then install an upper and have a complete rifle.
