Ok, i've searched google but can't come up w/ anything to this ?
<I'm posting here since it's not directly related to 240 section, eventhough i've seen a couple of 240's getting hit recently>
So, my wife & her sis<driver> got into an accident; she was going too fast in an offramp....totaled the windstar, cop gave a ticket for excessive speed/wreckless driving...
wife went to chiropractor for treatment since she was pregnant @ the time <april 2003/ due next month> & can't get xrays for her back...
Liberty Mutual <driver & my insurance co> saying that she should claim under my policy... but, i don't live w/ her or have her name in my insurance policy! she's in ny while i'm in south jersey & i only drive my car.
I said to her to go after the actual driver's insurance & i'm not liable for anything... isn't this correct?
"Spouse. Even if the spouse of the named insured is not named on a policy, liability insurance almost always covers him or her, unless the couple does not live together" http://bergenlaw.lawoffice.com...3.asp
my wife's not disclosing anything about me or my NJ address cause she agrees that i don't have anything to do w/ the accident...
Should she cave in & just give the attorney my name/addy/policy?Attorney/Liberty Mutual doesn't know that I have liability insurance w/ the same dam company.
<offtopic: sis-in-law got another windstar under full insurance now & drives like she's supposed to w/ 2 kids in the back; slow n steady>
thanx for any replies/links to clarify this
