Hey,

So after my window opening incident, twice, i was wondering if i could somehow get the dealership to buy back the car w/o losing a significant amont.

These are my reasons for doing this.. The first day my cars windows were down, i found puddles everywhere inside the car.. I did my best to dry it and of course, couldnt dry the whole vehicle. The next day, it began to snow.. ( Since my car had water in it previously, imagine the internal damage that could have occured. I.E water in the cracks of the window/up down button and etc) My windows went down again. My car was covered in ice in the interior. I couldnt drive it, i had to get it towed. I have pictures on my phone but dont have a connector thing, so i cant upload it.

So now im worried about the following.. Since the carpets were soaked, im worried about rust/mold developing on the floor. Also, ALOT of water got into the vents ( where the AC comes from) which im afraid may again cause mold inside the AC unit. Thirdly, I just dont want to be liable in the future for rust/ w/e happens b/c of water damage even though it may be little.

You guys think this is enough to get a buy back going? Really need help now..

I dont want to have an unreliable car in 5 years.

I really don't see a need to post about the same topic 3 times. As said before lemon laws don't specifically exist in Canada. But you might want to review the Canadian Motor Vehicle Arbitration Plan (CAMVAP) to see how you can dispute you defects.

Hell, I've been doing it for months! Chow actually has a legitimate gripe; the least we can do is offer some constructive feedback, if we have any that is.

I'm not familiar with how things work in Canada, but I would start getting some legal advice from some where. Is there a Canadian equivalent to the Better Business Bureau? (CAMVAP?) Start threatening your dealer with legal action if they won't compensate you. The car is still under warranty, right? Didn't they acknowledge that the car did malfunction while overnight at the shop? That's a start at least.

I am 95% certain that you are not going to get any money back from the dealer. I don't know about lemon laws in Canada so you will need to look into that. The best bet would be to hope that there's no significant long-term damage, to get the dealer to fix as much as possible as soon as possible, and to get the key fob reprogrammed NOW.

The dealership said that the car was missing a "something shift key translocator"? I dont really remember but they ordered the part and now i must wait 4 days for installation.

So what does that do for what happened to your Coupe (Rain/Snow)?

I guess the damage is already done. Nothing they can do at this point, especially since it's not in the dealership's interest to replace the car.

I would still hold them responsible since they should not have sold a car without a translocator. If the window issue was caused by that, then you could technically hold them responsible and drag this out as long as possible. Demand compensation!

That's what I'm thinking.

What exactly is this Translocator, what does it do?

What happened to chow's Coupe is not right. What ever happens, do you think he should take the lost and SELL it? This is too much for the car!

Hey all!

Just wanted to let you know that all is not lost. My car was screwed up since the day I bought it. To make a long story short, since i have posted it here before, I will just say it had some electrical shorts.

The dealer is absolutely no help. They will place the blame on Nissan and tell you to take it up with them.

Your car should have came with a Lemon Law booklet, not sure about Canada. The process they told me to go through was the Better Business Beau's arbitration process.

After I had filled out the proper paperwork and was deemed qualified, we had an arbitration hearing. I met in a room with the arbitrator and a guy from Nissan called on the phone.

The arbitrator ruled in my favor!!! I faxed in the acceptance papers this morning. Nissan is required by law to issue me a replacement vehicle within 45 days! The system does work!!!

Lol, i hope im using the right term.. anyways we'll call it the translocator.

The dealership found that the "Translocater" was responsible for the windows coming down automatically. Therefore they're admitting that it's the cars fault for having the windows open in rain and snow. I've complained and asked them what they would do about the snow in my car/ rain, they told me that their going to take note, so next time i bring it in they'll know. Im playing way too passive here, im going to start to get aggresive with the dealership and demand somthing, although i really dont know what they can do. All i know is that its their fault that my windows came down and my **** was damaged. I just dont know what i can be compensated with, because, i doubt the car looks any different than when it wasnt rained/ snowed/iced on. The dmg will occur in the future, when the warranty is done. (The last thing i want to do now is buy extended warranty, b/c the dealership sucks)

ahh.I hate calling them and having them tell me that they will call me back in 5 MINUTEs. I wait for 30 minutes, call back, get transferred 5 times only to get an answering machine. I then call repeatedly and finally get an answer and get told that im impatient and blah blah blah. **** them.Sorry, im on a rant again.. Im going into the dealership in about half an hour and will be starting a fight Gotta wait for the bus!Lates.

Make the drive to Northern Virginia, and go to Browns Fairfax Nissan, and they will treat you right! lol! it seems so rare to have somebody that has pride in their work and customer satisfaction.

Don't back down for anything. They sold you a faulty car and should definitely be held responsible!

For sure, and tehy need to get repremanded for not dealing with you correctly! That should show up negatively on their monthly/yearly reviews! it is terrible.

Update:

Thanks for everyone for keeping up with this thread btw, it really helps.

So i get my car back after a 5 day wait, they replaced the translocator thingy. Before getting into the car i take a quick walk around to see if there are any bumps/dents. Nothing. Just that its really dirty.. I get into my car, take a look at the leather and interior.. Looks ok.. Except that the driver seats leather is kinda rippling, i dont know if its from normal wear and tear on a 3000KM car but w/e. I drive the car back home and before getting out, i notice a DENT in the inner door panel!! ( The rubber part right where the locks are) . I turn the car back on, drive back to the dealership and complain. I wait 30 minutes for the service manager, he comes out and takes a look at it and says I have to go to the nissan upholestery shop to see if it can be repaired, if not they can reorder parts.To make a long story short, i did it , and got the part on ORDER (a week maybe wait) But this is the most annoying thing in the world, they repair one thing and break another.. i hate this dealership.

BTW i bougth the car in BRAMPTON but have it at a nissan dealer in SAUAGA.

WATS WORSE IS MY INCIDENT!! i take my car in the dealer with 3 problems...come back out with same 3 problem plus a new clutch problem. Those kids in the shop must of did something and messed my clutch up....and they did not fix my existing problems...stupid son of a bishez!

A good service dept at a dealer makes the difference between enjoying the car or hating it. I must say mine has been very good so far.

Very true. I just dislike dealing with car dealerships and salesmen in general. They are only looking out for themselves.
