Nismo Rims + VDC = No Go

I've been reading and searching, and it seems if you go over 3% of the original tire size, the VDC will have a fit?

Is this true? I plan on buying the 09 3.5SE's, and it seems like it will be standard on those, and I want to put the 19in Nismo's on my future car.

Anyone have any input or insights on this issue?

rhetorical question: how does the car know all 4 tires are < or > 3% of stock diameter?
