I need to talk to a lawyer or a landlord.I figure theres a million people on here and atleast one could be a layer or maybe someone who knows a s*** load about laws.

whats your question. its been about 6 months since i took business law that delt with landlord tenant rights but i may be able to answer your question since i have delt with a few landlords?

Well for awhile My wife and I rented a town home. When we moved in the back gate to the driveway was chained to the fence because the hinges were broke. Well when we were at work a scraper guy cut the chain/lock abd took the gate. I told the landlord about this as soon I we found out. I just got me security deposit back with a letter saying that 200.00 was deducted from the SD for the insurance deductible. I dont see how they can do this. The man HAD to come into the yard to cut the chain. Shes stating that I left the gate open in the alley unchained but neither of us have proof.

Oh and she said Im lucky she didnt charge my the whole 800.00 to replace the gate. 800.00? I thought she said she reported this to the insurance company. :slap:

landlord like to scew you with deductibles. when it comes down to it an landloard can do basically whatever they want as long as they dont infringe on your right to a peaceful dwelling.. so the gate was stolen for scrap is what your saying?

Yeah. Thats the only logical thing I can think of. Scrappers around there will take anything. My wife found an old email stating that we told here about it when we found out.

and the landlord is saying you scrapped it. and is taking 200 dollars. yeah situations like this are tricky. cause he is really accusing you of stealing.

I don't think I have heard of anyone receiving 100% of their deposit back after renting a house/apartment/etc....ever, btw.

Their not saying I did it, Just the fact that it happen. I was not home when it happen an it was locked/chained. Im looking in my pictures to see if I have any with the gate and chain in it. Do you think that would help the case at all?

Couple of questions:

1. Do you still have a copy of the lease?
2. Were you actually still living in the apartment at the time? I couldn't quite tell from your description of the events.

I can try looking into the MD laws later this evening, but I can't give you real legal advice because that would be illegal. I can only tell you my understanding of the law - but if you want to take action, consult a real lawyer.

Ah, I love the American system. You can't do anything without a license.

You might be right about some things, PMQ, but when it comes to law, I'd say it's better that we have those restrictions. If the consequences of you being inadequately represented (when you thought you were adequately represented) could ever be that you end up in jail, I'd say that it's a pretty fair requirement to say that we have some kind of protection for people not to be swindled by wannabe lawyers.

Similar for doctors, only swap "in jail" for "dead or deformed."

+1. A study abroad student at PSU got popped by the local cops for selling sunglasses at the football game without a license. The kicker is that this was a required assignment for his engineering economics class, and not necessarily for profit.

If you can prove that you told the landlord about it, then you can take them to small claims court over it. But just because someone stole something from the property doesn't mean you're off the hook for it, and the landlord was not necessarily accusing you of stealing it either. It may very well state in your contract that you are responsible for the deductible for anything gone wrong (don't know if this is legal or not in Baltimore County, check the HUD website).

But $800 for a gate is absolutely ridiculous, and he/she knows it is. I could see $200 if it was big enough, but you need to find out what insurance company they use and check to see if they actually filed a claim and if a deductible was charged them.

Why doesn't the landlord believe him?
Has he paid his rent frequently?
Does the $200 belong somewhere else?

If I was renting, and someone stole something off my property, and I gave my landlord a security deposit, I would never be ACCUSED of selling items off of the landlords property. Thats just not my nature.

Apparently something else is going on for the landlord to absolutly believe that the tendant STOLE a fence, and scrapped it.

Sometimes not being a D*** gets you a lot further in life.

Not all of us have money to to give to people so...your dumb

No Police report which was dumb on my part but my wife found some emails with us telling her about the fence. We're going to see a Lawyer about it because from what I understand I could win. I have emails and pictures and she has nothing. Ill let you guys know what I hear. Thanks for all the help :dblthumb:

You could win, depending on some of the issues at play, but even then, it's $200 - it's hard to justify a legal action for any amount that small.
