need advice on an issue with my title

ok. so this past saturday i purchased a 95 SE that had been wrecked. filled out the bill of sale, got the title from the owner, etc. well yesterday i went to the DMV to have the title changed to my name and come to find out, the guy i bought it from never had the car moved to HIS name. so i gave the guy a call and he said that the guy he bought it from was his cousin and that they would give me a call today and meet me at the DMV to get it straightened out. now this morning comes....and no phone call. so around 1130am i call him up again and he says he is on his way to pick up his cousin and will call me in about a half hour. 2 hours later there is still no call, so i called the guy again and this time his phone was off so i went ahead and left a voice mail. what do you guys think i should do? i paid him his money and got the legit title in my hand. i doubt the car is stolen or anything. i dont understand why the guy would be so difficult for something so simple

Step one.... Say whoops and smack yourself on the head.

Two... if they don't require Notary, create a bill of sale and put the real owners name on it and go to another DMV this time. If you require more than a bill of sale, take the title back to guy and say listen, we need to have the real owner sign this / notarize this, whatever your stat needs. If he gives you BS.... call police he sold you a car that was not legally his and it's theft through deception. Take to court get refund. If that doesn't work... part car out, tow shell and drop in a busy intersection late at night.... when the police come and tow, then bill the titled owner well hes gonna wish he flipped that title.

I'm not sure on Alabamas laws but in Texas since you have the salvaged title you can get the title in your name by saying you tried your best to find the original owner(if you can get ahold of his cousin yourself that would be the easiest), insure the car against any leans(like 150 bucks depending on value of the car), and then paying the title transfer and tax. The dmv doesn't make it easy to do here but it is possible if you go through all the hoops.

Alabama doesnt require notary. i thought of just creating a different bill of sale...but on the back of our titles here there are places to write in a transfer of ownership. they partially filled that part out but never completed it...i wonder if a new bill of sale would work anyway?

o there has been plenty of me smacking my head. lol. but i just dont get what he has to gain...he just seems lazy. ive got the guys address so if he keeps avoiding me i could always just go knock on his door

that will definitely be my last resort course of action...id probably make some profit by parting it out too :chuckle: but i just managed to track down the phone number of the guy whos name is on the title, not the one i bought it from. so hopefully that will work out :gotme

If no luck, type out a bill of sale, have a buddy sign it up, and go to another DMV

definitely going to do that if no luck with this guy. im already attached to this car and i havent even turned a wrench on it yet (been having trouble finding a cheap/free way to transport it to the storage place im keeping it at. im about to just bite the bullet and pay the $65 to a towing company). thanks for the advice guys

another question on this. i was unable to contact the original owner and the guy i dealt with is still being uncooperative. now if i went the route of a new bill of sale there could be a slight problem, on the back of the title is a place to fill out a transfer of ownership. on here it has been partially filled out. after calling the DMV and asking they said that the original owner would need to sign something saying that the sale never happened, but the original owner is no where to be found. however i may have found a loophole....right above the transfer section on the back of the title it says real big "notice: any alteration or erasure voids the assignment and all assignments that follow" i was thinking if all else fails, i could put a nice neat line through the few parts filled out on the back, which because it has been altered and/or erased, should void that assignment. does this seem like it would work and be legit? on the back of the title the transfer section wasnt completed fully like it says is required. i dont want to get in any trouble over all of this

Ive been through this a couple times. Get an affidavit from the bmv, have it filled out stating that the title was signed in error, and that the car was actually sold to you. Have a friend sign the original owners name, take it to a different branch, and you should be good to go. Just be sure its not stolen and there are no other issues with the title.
