I purchased this beauty on November 12, 2014. I was at Carmax, in the market for a Rogue or Murano. A gorgeous grey color caught the corner of my eye. It was a sedan, so I almost didn’t investigate. When I arrived at the grey car I noticed a subtle two tone pinstripe. I liked it. I opened the door and fell in love. Once I sat in the “cockpit” I knew I would be driving it home. I was in a different world. The first thing I noticed was the brushed stainless steel accents. Then I saw the Navigation System. I got the keys immediately. The test drive was unlike any other vehicle I had experienced, ever. I had no idea cars performed like this. I had never owned a performance car. I was in awe. When we got back to Carmax and went inside to work out the details, there was a buzz; other perspective buyers were questioning their sales representative if I was taking the Infiniti, they evidently first saw it when I exited the parking lot on my test drive. I told my salesman, “of course I am taking it”. Did he even have to ask? I put down $10,000.00 cash, my entire savings. I also purchased the extended warranty and the GAP insurance.

The first week in March of 2015, I arrived at the yard at 5:15am, 20 minutes early for dispatch (I worked for a staffing company that staffs the guys on the back of trash trucks. I do payroll, accounting, and all the office aspects). Once I purchased the Infiniti it didn’t matter what time I left for work in the morning, I was ALWAYS on time. I decided to go by my office and get fruit for our guys, on the back of the trucks. Once I locked the office door, I headed back to the yard. It was still dark outside when I made the left onto Auto Park Way, traveling west. I commented to myself how dark it was, there are no street lights on this street and it was now around 5:35am.
All of a sudden I see the outline of something black parked next to the curb in my lane…..I quickly swerved to the left and thought I had cleared it when all of a sudden I felt a sudden jolt. My car raised up and to the left and landed with me in an agonizing disbelief. I felt a wave of dread come over me. Within 5 minutes the guys were arriving on their way to work. They all stopped to make sure I was okay. I had two knots on my head (my air bag only expanded half way, so I hit the windshield on impact and when landed) and my back and neck were really sore. That was not important at the time. Hoping to wake up from this nightmare was. More than a few of them had their own stories of hitting the same black car trailer or missing it by inches. One of our employees had hit it the morning before I did. The trailer I later found out is parked there all day and all night. Rarely moves or has cars on it. There is a field on that side of the street, no street lights and it is pitch black in the morning at the time we arrive at work. I come from the other direction when coming to the yard from my residence. I wasn’t used to seeing an unattached, black, empty car trailer taking up the whole lane of traffic. I couldn’t imagine that the owner wasn’t breaking any rules, laws or ordinances. A Harris County Sheriff came to the scene. He wrote me a ticket for failure to stay in my lane. Really?? I would have hit the trailer head on! No, I did not stay in my own lane. He never said that the trailer should not have been parked there. I found that odd and decided to look into that later. One of the workers had a friend that has a repair shop down the street from the yard and he came out and towed my car to his shop. Thank goodness. He has been very kind and patient with me while I am trying to figure out what to do about everything, with no one to advise me.
My Infiniti is being repaired at the shop it was towed to that morning. I am paying for the repairs myself. I put $1200.00 down as a commitment of payment in full when the repairs are completed. We discussed the price difference of using new Infiniti parts and used parts off of E-bay and such. I went with the used parts from the internet. It broke my heart to make that decision, but I didn’t feel I had any other choice. Since then, I was fired for being late to work on a Saturday morning (the 2 site supervisors were there, Saturday is the shortest day for trash, they start coming back to the yard at 11:00am. I pass out blank time sheets to the guys before they get on their assigned truck). My ride was late picking me up due to car trouble. I was told I was being fired for being late and not having my own vehicle to get to work. My boss told me that was a requirement of my job, in case I am needed to pick up or drop off someone at a route. That was the first I had heard of that requirement after a year and a half of working there. Usually I would take my roommates vehicle, 5 out of the 6 work days. The car sat in the parking lot of my office every day from the time I got there, after leaving the yard at about 7:00am, until I left work which was anywhere from 10 to15 hours later. (By the way, I was paid salary, for 40 hours a week even though I worked six days a week with a minimum of 60 hours a week).
I found an attorney on line a couple of days after the accident and he sent me to a chiropractor. I was trying to contact him for three weeks regarding the case because I didn’t know what to do about the car payment, the car repairs, the insurance, I just had a lot of unanswered questions and people were calling wanting money. The girls that answered the phone kept sending me to voice mail. I kind of got on them about sending me to voice mail for another week, with no response. The next day he called to inform me that they won’t be handling my case any longer due to the ticket I received for failure to stay in my lane. At that time I hadn’t even had my first court date yet. No, I did not stay in my lane, I would have hit the trailer head on. I could not continue to go to the chiropractor with no income. Now I have a pinched my sciatic nerve on my right side; my neck, shoulder and left arm have some type of injury, possibly nerve damage. I cannot sit, stand, or lay down without wrenching pain. I am in constant severe pain. I have been to the ER two times, the clinic two times, two doctors and a pain management facility. I need an MRI on my back and neck, shoulder and arm. I do not have the money for that. I will not be able to pay for the repairs to my Infiniti and I will lose the money I have already given to repair my car. My car note is behind since I got fired. I am in desperate need of getting my injuries diagnosed and treated so I can go back to work. People are telling me to let the car go, but they just don’t understand! I figured the only people that could understand what I am feeling is y’all, other Infiniti owners and enthusiasts. Y’all know exactly why I can’t let my car go. I also put a lot of money down on my car. I can’t see just walk away with no car, no job and debilitating injuries that could cause permanent nerve damage if not taken care of soon.
I am a single female. I have not had anyone to advise me on what steps I needed to take to get my car repaired and get my injuries taken care of. I don’t know if an attorney can help me and if so, where to find the right one. I need to get back to work. I have never asked anyone for help before. I have always been very independent. I have been working since I was 10 years old. (I had a paper route.) I have been on my own since I was 16. I used to have two full time jobs most of my life, or a full time job and full time school, University of St. Thomas. I have tried to write this “campaign” for three months, hoping something would occur and I wouldn’t have to ask anyone for help. The only thing that has happened is my injuries have gotten worse. I really need some advice from someone. I think I need an attorney. I have spent hours researching different aspects of the situation that I am in. I believe that the owner of the trailer should be held responsible for the
repairs to my car and my injuries. I don’t know if I can hold him responsible for losing my job, due to transportation problems. I’m also having a problem with the insurance. When I called about the accident they told me my policy was cancelled. I never received a cancellation notice and neither did my lien holder. The insurance company will not send me a copy of the documentation that they sent regarding the cancellation. They won’t return my calls or respond to my emails. That is why if I want my car back I have to pay for the repairs myself.
Ever since the accident anything that can go wrong, has gone wrong. I am hoping that someone can help me with what I need to do, and how I need to do it. I have to get my car back, and at this time I have almost no money in the bank and no income. I have to get my injuries treated. I have to get back to work. I am in desperate need of funds to pay for the repairs and to catch up my car payments. If anyone is able to assist me with the things I need, anything, I would appreciate it so much. Sorry to hear about your troubles.

You need a lawyer to get that ticket dismissed first. You may have missed the time period to get a court date though. Talk to a lawyer to make sure.
Why didn't you have your insurance take care of the repairs and cover your health costs?

You need another lawyer to sue your insurance company, as long as you were up to date with payments before this happened they have to cover you.

If your airbag only half deployed you may have a case against Infiniti as well.

The case would not be against Infiniti. It would be Carmax wouldn't it? I am concerned with the owner of the trailer and I would like to explore the insurance. I am not an expert on these rules and laws. I am having to look all of it up on the Internet, look at the most trusted sources and go from there....Thank you for you links. I appreciate your help.

Ok, so I read your entire sob story, and I apologize if it's legit, but for me, there are too many red flags popping up.
Insurance mysteriously cancelled?
Air bag not fully deploying?
Paying for your own repairs?
Getting that traffic ticket for being in the wrong lane?
Getting fired from your job because you lost your car?
This does not pass the smell test.
Maybe someone out there will send you some cash on your paypal account, but it won't be me.

Good Evening Buzzman, yes I understand your concern about my "sob story" not being true. While writing the letter I wanted to make sure I did not come across as a fraudulent situation. That is why I added the pictures and video at the end of the letter, I included a pic of the repair shops website, therefore, anyone can call to verify, or stop by if in the area. I included the Bill of Sale from Carmax, the down payment receipt from Carmax, several pics of the wrecked car, including plate information, VIN# can be located on pics, there were 2 documents that photobucket informed me that it could not post. I am not replying to you to change your mind and send me money. As a matter of fact I appreciate you replying to my post in the manner. There are probably alot of people who thought the same thing, just did not take the time to respond. So Thank you. The insurance not paying is not a mystery, I didn't want the letter any longer than it was.
When I called the insurance company after the accident I talked to someone that did not work in the office of where I got my policy, because they were not open yet. He informed me that I was not on his system. I called when office opened, I was told that my policy had been cancelled weeks before because i had 2 accidents both by bumping the person ahead of me at the red light, after stopping. One incident had a zero claim and the other one had a $589 claim for a bumper. One was in 2013 and one in 2014. The insurance company new about these accidents the year before when I had my previous vehicle insured through them. He told me that they re-evaluated all their clients and cancelled all the people with two of more accidents. Even though one of them had no claim. I asked where my cancellation notice was, because I never received one, nor did my lien holder. He could not provide me with any type of documentation regarding the cancellation. I tried to get ahold of them in the weeks to come, my calls were not answered, emails not responded to, Finally someone called me back. He explained to me that I was lucky he was calling me, because no one else was responding to me. He could not give me the date of the cancellation, could not provide cancellation letter to me or lien holder, there were no documents related to my policy regarding anything. That was the last I heard from their office. I talked to the Department of Insurance and they told me to file a complaint on-line. I started that process until I got to the part about my claim number. They would not take my claim so I did not get a claim number. That is when I found that law firm on-line.
I can show you the ticket information on court documents. I was shocked when I got that ticket. The Harris County Sheriff that came to the scene I had a problem with when we had to call the police at my job when a former employee posed as a current employee to get his paycheck. That was our first month of business at that location. The police brought the suspect to our office, but was threatening to let him go because the check that he forged was in Jackson, Miss. where the investors and our bank were located, and it was lunch time. I couldn't get anyone in the bank to send me a scan or fax of the forged check. I had a disagreement with the sheriff because I thought it was not right to give me some time to get the document from the bank. I could not believe he was going to let him go because he said he could not hold him with out the forged check. I was only waiting for the one person in that bank to send me the document. He was released and got away with stealing over $600 from a working employee. The way we caught him is he came in the next week to do the same thing. I guess sometimes crime does pay, this time $600. The sheriff kept asking me if I was on my phone when contact was made and I told him no at least 5 times. I wasn't on my phone. He then asked me if I had been drinking. The accident was at approx. 5:30am. No I had not been drinking and offered to take a test, which none were given.
I am not sure why the airbag would raise a red flag....There is a picture of the airbag in the pics. You can also see where I hit the windshield two times, with a seat belt on.
I thought I explained in the letter that I made the decision to repair the car now, because I need my car. I still have a car note. No one will sell me a car with payments when I have a car note on the Infiniti. I spent all my money on the down payment. I would have to finance another vehicle. The only options I knew to do was payments on the repairs or walk away. But I would still have a car payment to take care of. I need to find an attorney, but this time not over the Internet. I have been asking people if they know of one, but no one has given me a referral yet. I was hoping their would be an attorney in the Nicoclub that could point me in the right direction.
Yes I was fired from my job. I could probably find the texts regarding that event.

Like I said, I really have never asked anyone for help before, I don't know if the way I did it was wrong or not. I don't even know what i should expect if anything at all.,...That is why I emailed AZHitman with my letter first. He responded very positively and seemed to understand that it seems anything that could go wrong the the accident, besides the accident has not gone right. It's like everyday I was dealing with another set back and I wasn't sure how I should proceed. I made the best decisions I could after researching each problem from every angle. I am still not sure what is going to happen to my car. I am actively going to try what ever I can to go get my car at the end of October when he said it will be ready. I went and looked at it a few weeks ago. I tried calling the gentleman I had been dealing with, but he didn't return my call and didn't respond to my text, so I went by there the Friday before Labor Day my car was still sitting in the same location as before, not touched. I got a hold of him last week and he said he would have it completed by the end of October, and he will need the remainder of the first half of the repair bill at that time. I want to get back to work asap. I wasn't asking for people just to send me money. I was requesting any type of help. AZHitman was going to post it but he was real busy and suggested I post it and we would go from there.
I apologize if I offended anyone who read the post. I just came up with this idea because I knew that this community would understand why I could not walk away from my car. That is all. I am not trying to trick anyone, I just need some assistance and guidance. I have tried to do everything by myself but it's not going very well.

The red flags here are because you didn't realize that your insurance hadn't been taking payments, the irrelevant rant about the Sheriff and some other sob story claiming he has a personal vendetta, and claiming that losing your job was related to all this.

If I read the first post correctly (which was VERY hard to read, my apologies if my understanding is incorrect), it sounded like you were late (does this happen often or something?) and to have a car to get to work being required is sort of a formality. Given your kind of field work, that should be a no-brainer.

I apologize if I'm wrong, but it just sounds like you may be one of those people who believe nothing is their fault and someone who just might be a severe procrastinator.

Sometimes when the s*** hits the fan, it's partly because of 'bad luck' colliding with bad choices. That doesn't give anyone the right to be a douche.

Let's get this back on track. I'll agree 100% it's a tough read - no one's forcing anyone to read it. Perhaps someone with a little more patience can chime in.

Agreed. I'm a little confused why the insurance company wasn't contacted when this wreck happened. Like Daryl said, if you were up to date with payments and you never were given a notice, then I believe by law they have to cover you.
Which insurance company is this anyway? They sound small-time, maybe call the main corporate office instead of a local agent...

First order of business is just to get a lawyer, most have free consultations to see if you have a case. Talk to friends, family, etc to see if they know someone that is a lawyer or works at a law firm.
