I purchased this beauty on November 12, 2014. I was at Carmax, in the market for a Rogue or Murano. A gorgeous grey color caught the corner of my eye. It was a sedan, so I almost didn’t investigate. When I arrived at the grey car I noticed a subtle two tone pinstripe. I liked it. I opened the door and fell in love. Once I sat in the “cockpit” I knew I would be driving it home. I was in a different world. The first thing I noticed was the brushed stainless steel accents. Then I saw the Navigation System. I got the keys immediately. The test drive was unlike any other vehicle I had experienced, ever. I had no idea cars performed like this. I had never owned a performance car. I was in awe. When we got back to Carmax and went inside to work out the details, there was a buzz; other perspective buyers were questioning their sales representative if I was taking the Infiniti, they evidently first saw it when I exited the parking lot on my test drive. I told my salesman, “of course I am taking it”. Did he even have to ask? I put down $10,000.00 cash, my entire savings. I also purchased the extended warranty and the GAP insurance.
The first week in March of 2015, I arrived at the yard at 5:15am, 20 minutes early for dispatch (I worked for a staffing company that staffs the guys on the back of trash trucks. I do payroll, accounting, and all the office aspects). Once I purchased the Infiniti it didn’t matter what time I left for work in the morning, I was ALWAYS on time. I decided to go by my office and get fruit for our guys, on the back of the trucks. Once I locked the office door, I headed back to the yard. It was still dark outside when I made the left onto Auto Park Way, traveling west. I commented to myself how dark it was, there are no street lights on this street and it was now around 5:35am.
All of a sudden I see the outline of something black parked next to the curb in my lane…..I quickly swerved to the left and thought I had cleared it when all of a sudden I felt a sudden jolt. My car raised up and to the left and landed with me in an agonizing disbelief. I felt a wave of dread come over me. Within 5 minutes the guys were arriving on their way to work. They all stopped to make sure I was okay. I had two knots on my head (my air bag only expanded half way, so I hit the windshield on impact and when landed) and my back and neck were really sore. That was not important at the time. Hoping to wake up from this nightmare was. More than a few of them had their own stories of hitting the same black car trailer or missing it by inches. One of our employees had hit it the morning before I did. The trailer I later found out is parked there all day and all night. Rarely moves or has cars on it. There is a field on that side of the street, no street lights and it is pitch black in the morning at the time we arrive at work. I come from the other direction when coming to the yard from my residence. I wasn’t used to seeing an unattached, black, empty car trailer taking up the whole lane of traffic. I couldn’t imagine that the owner wasn’t breaking any rules, laws or ordinances. A Harris County Sheriff came to the scene. He wrote me a ticket for failure to stay in my lane. Really?? I would have hit the trailer head on! No, I did not stay in my own lane. He never said that the trailer should not have been parked there. I found that odd and decided to look into that later. One of the workers had a friend that has a repair shop down the street from the yard and he came out and towed my car to his shop. Thank goodness. He has been very kind and patient with me while I am trying to figure out what to do about everything, with no one to advise me.
My Infiniti is being repaired at the shop it was towed to that morning. I am paying for the repairs myself. I put $1200.00 down as a commitment of payment in full when the repairs are completed. We discussed the price difference of using new Infiniti parts and used parts off of E-bay and such. I went with the used parts from the internet. It broke my heart to make that decision, but I didn’t feel I had any other choice. Since then, I was fired for being late to work on a Saturday morning (the 2 site supervisors were there, Saturday is the shortest day for trash, they start coming back to the yard at 11:00am. I pass out blank time sheets to the guys before they get on their assigned truck). My ride was late picking me up due to car trouble. I was told I was being fired for being late and not having my own vehicle to get to work. My boss told me that was a requirement of my job, in case I am needed to pick up or drop off someone at a route. That was the first I had heard of that requirement after a year and a half of working there. Usually I would take my roommates vehicle, 5 out of the 6 work days. The car sat in the parking lot of my office every day from the time I got there, after leaving the yard at about 7:00am, until I left work which was anywhere from 10 to15 hours later. (By the way, I was paid salary, for 40 hours a week even though I worked six days a week with a minimum of 60 hours a week).
I found an attorney on line a couple of days after the accident and he sent me to a chiropractor. I was trying to contact him for three weeks regarding the case because I didn’t know what to do about the car payment, the car repairs, the insurance, I just had a lot of unanswered questions and people were calling wanting money. The girls that answered the phone kept sending me to voice mail. I kind of got on them about sending me to voice mail for another week, with no response. The next day he called to inform me that they won’t be handling my case any longer due to the ticket I received for failure to stay in my lane. At that time I hadn’t even had my first court date yet. No, I did not stay in my lane, I would have hit the trailer head on. I could not continue to go to the chiropractor with no income. Now I have a pinched my sciatic nerve on my right side; my neck, shoulder and left arm have some type of injury, possibly nerve damage. I cannot sit, stand, or lay down without wrenching pain. I am in constant severe pain. I have been to the ER two times, the clinic two times, two doctors and a pain management facility. I need an MRI on my back and neck, shoulder and arm. I do not have the money for that. I will not be able to pay for the repairs to my Infiniti and I will lose the money I have already given to repair my car. My car note is behind since I got fired. I am in desperate need of getting my injuries diagnosed and treated so I can go back to work. People are telling me to let the car go, but they just don’t understand! I figured the only people that could understand what I am feeling is y’all, other Infiniti owners and enthusiasts. Y’all know exactly why I can’t let my car go. I also put a lot of money down on my car. I can’t see just walk away with no car, no job and debilitating injuries that could cause permanent nerve damage if not taken care of soon.
I am a single female. I have not had anyone to advise me on what steps I needed to take to get my car repaired and get my injuries taken care of. I don’t know if an attorney can help me and if so, where to find the right one. I need to get back to work. I have never asked anyone for help before. I have always been very independent. I have been working since I was 10 years old. (I had a paper route.) I have been on my own since I was 16. I used to have two full time jobs most of my life, or a full time job and full time school, University of St. Thomas. I have tried to write this “campaign” for three months, hoping something would occur and I wouldn’t have to ask anyone for help. The only thing that has happened is my injuries have gotten worse. I really need some advice from someone. I think I need an attorney. I have spent hours researching different aspects of the situation that I am in. I believe that the owner of the trailer should be held responsible for the
repairs to my car and my injuries. I don’t know if I can hold him responsible for losing my job, due to transportation problems. I’m also having a problem with the insurance. When I called about the accident they told me my policy was cancelled. I never received a cancellation notice and neither did my lien holder. The insurance company will not send me a copy of the documentation that they sent regarding the cancellation. They won’t return my calls or respond to my emails. That is why if I want my car back I have to pay for the repairs myself.
Ever since the accident anything that can go wrong, has gone wrong. I am hoping that someone can help me with what I need to do, and how I need to do it. I have to get my car back, and at this time I have almost no money in the bank and no income. I have to get my injuries treated. I have to get back to work. I am in desperate need of funds to pay for the repairs and to catch up my car payments. If anyone is able to assist me with the things I need, anything, I would appreciate it so much.
