suing him would do no good. my insurance co. has first rights to any award. they doubled my limits since i had 2 policies with them (uninsured motorist on 2 vehicles). they paid almost $16,000 in lost wages, $2900 for the car, $5000 towards medical, and $76,000 in pain and suffering, after they reimbursed my health insurance company for what they paid out. basically, if I get anything from this guy in court, the first $108,000 would go back to the insurance company, i would be out attorney's fees, time and hassle of court, etc. so it's not worth it to pursue it any further.

they are going to sue him anyways, to recover their costs. with attorney's fees and their service charges, i would imagine they are going for somewhere around $140,000. i wish them good luck.

they haven't dropped me, and i don't think my rates have skyrocketed. we really aren't in the same situation as before so it's hard to tell. before we had full coverage on the versa, and liability/uninsured motorist on the 240, but now we have full coverage on the truck and the RX8.

I don't blame you for wanting something bigger. I was in a simular crash. A truck spilled it's entire load on my car, causing me to spin and hit a wall at 40 mph head on. Surprisingly, my car held up pretty good for being rammed into a wall at that fast of speed. I walked out without scratch.

However, the car I had restored for 3 years was gone in 30 seconds. I poured my whole life into that thing.

I'd 100% go to a chiropractor. I know you went to a hospital but almost nobody walks away from a car wreck with their back being untouched. The hospital most likely did scans and whatever but still. I fell off a trampoline and broke my shoulder turns out 3 years later I have trauma induced scullioses? (SP) and a reverse arc in my neck. If I didn't end up going then by the time I'm about 25, I'd be hunched over like an old man.
